No slam dunk and conservatives can make a good case either way.
The good thing about counting persons as opposed to citizens and birthright citizenship is that the gov has very little to no interpreting who is counted. Anything else puts us at the mercy the king to grant citizenship.
And the Dems will rule as Kings. Wouldnt be surprised to see the Dems strip citizenship of mean people and disallow citizenship for children of hate groups. Or perhaps disallo so many whites people from being citizens.

This issue has simmered throughout the history of this great nation. Before we became the United States we argued about the status of American Indians (Native Americans to the Liberals out there) And what about slaves: were they to be counted or not (the compromise was the 3/5th rule). Additionally were had a constant inflow of immigrants who where citizens or subjects of foreign sovereign rulers. The Royal Navy believe that British immigrants were still British and could be pressed into the Royal Navy. We disagreed. French and Spanish subjects were living, some for generations, on land that became part of the United States. Our Japanese immigrants, many of them U.S. citizens were rounded up and sent to concentration camps out of fear that they still obeyed the Emperor. Illegal immigrants have been the latest folks in the the middle of the argument.
The current rule is that we count everyone, except diplomats, and presumably anyone who are here as tourists or transients. SCOTUS will have to decide, the Constitutional original intent was to count permanent residents except members of another sovereign entity (American Indian tribe). Slaves sorta counted but only as a 3/5 person.

You're right, of course. In reality ACB will take Kavanaugh's seat as everybody else moves up one seat. (Except for Roberts. As Chief Justice he stays at the head of the table.)
But how will the administration know who the illegal aliens on the Census are if they were not allowed to ask?

Actually, Ginsberg took Byron White’s seat in 1993. And rumor has it that Justice White’s dying wishes were that the Supreme Court never be packed to exceed nine justices and that ACB be confirmed before election day 2020.
I don’t believe that is necessarily true. If she did not hear oral arguments she still has the ability to read the transcript and review the case.
She can still vote on the case.

My mistake — the Committee vote is scheduled for the 22nd. The vote should be the following week — the week beginning Monday the 24th.
I agree, it makes no sense to count illegals, but I have a feeling the Supreme court will disagree.
If the census comes out with two sets of numbers, the allocation of the House will be the next court case: which set of numbers do you use?

I don’t see how this appeal can win. We counted non-citizen slaves, although only at 3/5 level.

There are people who do NOT have residence in a community.
