The justices put the case on a fast track, setting arguments for Nov. 30. A decision is expected by the end of the year or early in January, when Trump has to report census numbers to the House.
Trump’s high court nominee, Amy Coney Barrett, could take part in the case if, as seems likely, she is confirmed by then.
Last year, the court by a 5-4 vote barred Trump from adding a census question asking people about their citizenship. Justice Ruth Bader Ginsburg, who died last month, was part of that slim majority. Barrett would take Ginsburg’s seat.

The fact that they are illegal is enough in my book.
If they are not citizens, they should not be counted.
How exactly would it be determined who would be excluded? There’s no question on the census regarding birth location, SSN or citizenship.

As I understand it, the question is whether illegal immigrants should be included in the apportionment of representatives. Two states, one with 1 million residents, all citizens, versus another state, 2 million residents, 1 million being citizens. Should they get the same number of representatives? Or should the second state get twice as many reps as state 1?
In the past, as I understand it, the apportionment was based on aggregated legal and illegal residents, Trump wants apportionment based on count of legal residents only. The effect would be for California to lose a number of reps.

If the US can’t remove illegal aliens from a census used for Constitutional apportionment, then we don’t deserve to survive as a country. Just go ahead and split up, and start Civil War II.
Kamala Harris was moaning to ACB about a part of the Voting Rights Act declared unconstitutional. ACB said something about reworking the formula.
But that’s a little problematic if you don’t know who’s a citizen and who isn’t.
