Kyle Rittenhouse will not face gun charges in Lake County related to the AR-15-style weapon he is charged with using to kill two men and wound a third during violent protests in Kenosha in August, prosecutors announced Tuesday.

An Antioch police investigation found that the Smith & Wesson .223 caliber rifle “was purchased, stored and used in Wisconsin” and turned up no evidence the 17-year-old “physically possessed” the weapon in Illinois, according to a news release from the office of Lake County State’s Attorney Mike Nerheim. The news release does not reveal who is believed to have bought or held the gun before the shooting.

I’m thinking it will all get reduced to a 17-year-old having a weapon. that’s the weak part of the defense.
Some Wisc. attorneys think that law is cut & dried and he’s golden.
Some think there is another part of the law that makes it all ambiguous and contradictory and he’s hosed.

should be interesting...

It’s a bellwether. Wisconsin has a weak case. If one prosecutor is unwilling to try it, the other is probably of the opinion that it’s not a strong case for the state. Rittenhouse may still be prosecuted, but it’s winnable.


It would seem that there’s a strong argument that this case meets the high standards to deny extradition to Illinois at all. Not that I expect Illinois to make that stand.

There is a specific exemption in the Wisconsin law against minors with dangerous weapons for 16 to 17-year-olds possessing long guns.

It seems clear to me in what was written in the law.

I actually started law school. But then I went into computers instead, where “if...then...else” can be relied on every time. The law is whatever the most connected person wants it to be at the time no matter what it actually says and law is just BS. In computers, that is called self-modifying code, which is seldom used outside of viruses.

The goal though, as I know you know, is for Kyle to be exonerated of all these bogus charges so he can go on to continue being the Great American he already is.

unless you run into a whacked altered go to... retired from 30 years of testing software - mostly cobol\assembler...plus a couple of mid 60's years in operations.

HA! Just the thing I was thinking of. The only time I ever wrote COBOL was in a college course. At that time “alter to proceed to” was explicitly discouraged in the manual but still in the compiler and I deliberately used it in a programming assignment, just for fun.

You are correct. However, this incident has no military merit on any level.

In My experience w/ troops in contact you may be surprised at how confident and composed most are when being bloodied.

Training and more training. I would suppose young Kyle has a bit of combat drilling with an AR under his belt.

The only fault I can see is no battle buddy present.
