As the Holy War concerning filling Justice Ginsburgs seat begins in earnest, one question which the Republican side and President Trump should certainly pose, is what would the Democrats do if the situation were reversed? Without question, they would have a Democrat president nominate a new Justice, and the Democrat Senate majority would rush to confirm that nominee. In all likelihood, Democrat discipline would work to hold their majority together and the nominee would be confirmed.
Already, two Republican Senators, Susan Collins of Maine and Lisa Murkowski of Alaska, have indicated they would not vote to confirm a newly appointed Justice before Election Day in November. Collins has gone farther, indicating she would want the newly elected president to fill the seat. If the winner is Trump, then in essence she is saying she would consider voting for Trumps nominee, probably to be announced this week if the confirmation vote were held after Election Day.
Collins has never opposed a Supreme Court nominee proposed by a President from either Party since she took office. She has supported well over 90 per cent of judicial nominees proposed by President Trump. She may be trying to restore her reputation of independence among voters in Maine, who at the moment appear to favor her rival Sara Gideon for the Senate seat being decided in less than 7 weeks. Collins voted for Bret Kavanaugh, and made a principled, comprehensive presentation of her reasons for doing so. Her vote was the one that put Kavanaugh over the top.
For any open-minded voter in Maine, her explanation of her vote and the process she went through before deciding, should have enhanced her reputation. But we are in a resistance culture,

Collins needs Maine Republican voter support.
Profiles in Courage???Not!
Absolutely they should abstain. Theres a substantial difference between being a conscientious objector in a war and being one who takes up arms with the enemy and opens fire on your side.
RE: Collins needs Maine Republican voter support.
Yes, but how numerous are they?
“Before election day” is noteworthy.
But should litigants have to wait an extra month for their decisions?
She wont get it sitting on the fence. And she wont get it voting no.
Independence and moderation doesn't win elections. Sorry. Firm convictions and beliefs and strong support for them wins elections. She's going to lose unless she does something to help conservative Republicans support her, abstaining is a possibility as it is in effect a vote of support.
If these female RINOs abstain, that leaves Romney as the wildcard. Let’s be pessimistic and assume that his hatred for Trump is greater than his love for country (not an unrealistic assumption)... that makes the confirmation a 50-50 split since Republicans control the senate 53-47.
This leaves Mike Pence as the tie breaker.
Abortion is a non-issue.
Abortions will always be available in CA and NY.
Enough to help her win or lose. She needs to act like a Republican and support her party.
Always the usual suspects. If they aren’t going to support Republican platforms and a Republican president then they need to change their party affiliation.
Better yet would be a no show for the vote.
But if 3 Republicans abstain, that would leave the vote at 50 - 47 and the nominee would be confirmed.
The author of this article didn’t explain the difference between abstaining and voting no. I guess abstaining is not the same as voting no? In other words if they abstain, then there are only 98 votes and only 49 are needed for confirmation?
But if 3 Republicans abstain, that would leave the vote at 50 - 47 and the nominee would be confirmed.
+++++
Indeed. I and a few others have been preaching this idea to the Freepers since Saturday. My view is we could have 6 GOP Senators abstain with Pence breaking a 47-47 tie.
The question needs to be put to them - Why do you think it is OK for you not to do your job that you were elected to do?
why can’t they confirm him/her after the election, and before the new congress takes over?
Not supporting a qualified woman is pathetic, not sure how any GOP voters would support either of these two.
If it is the “plurality of the Senators voting” and all cast a vote -including abstentions- the decision will be based on 51 votes for or against.
Abstentions are votes and do not get removed from the total.
