On Saturday, President Donald Trump rallied the Republican Party to confirm a Supreme Court nominee to replace the late Justice Ruth Bader Ginsburg. He called filling the vacancy an “obligation” to be fulfilled “without delay.”

“We were put in this position of power and importance to make decisions for the people who so proudly elected us, the most important of which has long been considered to be the selection of United States Supreme Court Justices,” the president tweeted. “We have this obligation, without delay!”

Ginsburg, an impressive justice and a liberal lion of the Court, passed away on Friday at the age of 87.

Senate Majority Leader Mitch McConnell has said the Senate will consider Trump’s nominee to the Supreme Court.

Democratic nominee Joe Biden has called for the Senate to wait until after the election, rather than rushing to confirm a potential Trump nominee.

Elections have consequences. Judicial appointments are, at their core, political. When you have a Republican President and majority Republican senate, you get to choose nomination timing and who will sit on the Supreme Court. When Merrick was named by Obama during a presidential election year, he would be sitting on the SC now had he had a Dem senate. He didn’t. He loses. Simple as that. Dems would do it too. They even go a step further in threatening to pack the court as their backup legislature when they return to power. Spare us the faux virtue fantasy bin denying the reality that the judiciary at its highest level is immune from the political realm when it comes to cases involving political public policy Justices confirm such is the case by straight party line votes from the bench. It is what it is whether we like it or not.

During the 1844 election, for example, there were two open seats on the Court. John Tyler made nine separate nominations of five different candidates, in one case sending up the same nominee three times. He sent up a pair of nominees in December, after the election. When those failed, he sent up another pair in February (presidential terms then ended in March). He had that power. Presidents have made Supreme Court nominations as late as literally the last day of their term. In Tyler’s case, the Whig-controlled Senate had, and used, its power to block multiple nominations by a man they had previously expelled from their party.

Despite what Biden claimed, Obama’s nominee was not brought up for a vote in 2016 because that was his last year in office, the year he nominated Garland, and no president has had his nominee approved under that scenario with an opposition party controlling the Senate since the 1800’s and Republicans controlled the Senate in 2016.

This is not currently the case for Trump as the President and majority Senate are now of the same party. Therefore Trump gets his pick and Obama doesn’t! Too bad for Dems. LOL.

The only people fired up about stopping this pick are the same people who are already fired up about voting against Trump anyway. This is a battle for the hearts and minds of the undecideds and also the Never Trumper Republicans flirting with the idea of voting for Biden.

There need not be hearings. After Kavanaugh, the Democrats will not behave in good faith anyways. Any Republican senator who stonewall this will be committing political suicide and they know it.

For the quickest possible confirmation of a conservative to the USSC, perhaps Trump should nominate Ted Cruz, who he just added fo his list a few days ago.

Cruz is a well-known figure already to the public and to his Senate colleagues. Of course, the Dems are going to fight the nominee no matter who it is, but I think this puts Trump in the best position to get the seat filled by a solid conservative Constitutionalist.
