Devin Nunes: John Durham could 'intercede' in Michael Flynn case

U.S. Attorney John Durham's criminal inquiry into the Russia investigation could disrupt the case against retired Lt. Gen. Michael Flynn, according to a top House Republican.

Rep. Devin Nunes, the ranking member of the House Intelligence Committee, told Fox Business on Thursday that there are two factors that could shake up the protracted legal fight.

"I think a couple things could intercede here. One could be that Durham or another U.S. attorney comes up with indictments," the California congressman said. "The second thing is that there could be more evidence that could show up."

Durham's investigation, which Democrats fear could amount to an "October surprise," is expected to produce a report by the end of the summer, according to the Justice Department.

A federal appeals court in Washington, D.C., agreed on Thursday to take up the case involving the Justice Department's motion to drop the prosecution of President Trump's former national security adviser. Nunes contended that the court is "overwhelmingly" Democratic and is trying to "stall" with less than 100 days until Election Day.

Flynn, a target of the special counsel Robert Mueller's Russia investigation, pleaded guilty in December 2017 to lying to FBI investigators about his conversations with a Russian envoy during the presidential transition period. After changing legal teams, Flynn started to argue this year he was innocent and had been set up by the FBI. The Justice Department then moved to drop the prosecution, but the judge overseeing the case, Emmet Sullivan, has resisted immediately doing so.

Impossible. We’ve been lead to believe for over a year that Durham was a prosecutor and they issue indictments not reports.

Ever see the TV show “Designated Survivor”? One of the plot lines involves actual spying by a “moderate” Presidential candidate on his more conservative rival. The show started after 2016. Now, is this plot line a total coincidence? Who knows.

Here’s an idea sketch. Likely won’t happen but boy would it be a beauty to behold:


The DOJ dropped all charges against General Flynn. The DOJ was/is the sole prosecutor and there can be no other prosecutor as this is strictly a federal case.

The DOJ is part of the Executive branch of federal government and is completely separate from the Judicial branch.

Sullivan, and now apparently the DC Court of Appeals, are breaching the separation of powers laid out in the Constitution between the Executive and Judiciary

The DOJ can file a motion (I am thinking) with SCOTUS to suspend the DC courts from breaching the separation of powers and to declare any further delay in granting case dismissal as a de facto continuation of said breach.

Upon granting motion to suspend, the DOJ can claim bad faith on the part of the DC courts and request leave to transfer jurisdiction to federal courts outside DC.

Upon granting leave to transfer jurisdiction outside DC, the DOJ can request precedent to transfer all cases pending or in preparation, transfer outside DC courts.

The White House, citing bad faith, can file a complaint with SCOTUS to bring the DC courts into a receivership where special court masters are appointed to investigate corrupt practices of the DC courts using declared bad faith the Flynn case as pretext.

Meanwhile, SpyGate, FISAGate, and others can be filed in federal courts outside DC.

My point was that we are being gaslit into believing that Durham and his Democrat prosecutors are doing something of substance. Clearly, they are not. Preparing another report on the coupist attacks on POTUS is as useful as you know what on a bull. We need action and not more beltway hot air.

Okay, let us suppose for the sake of conversation, that John Durham does in fact exist as a real person and does hold a position of authority in the US DOJ.

How, exactly, would he intercede in the Flynn case?

Evidence is not going to clear Flynn. That is not the issue.

The issue is the Racist Judge Sullivan reading on the Internet.

You aren’t fighting facts, you’re fighting a Federal Judge that is racist and believing all the Russiam myths on the craziest Left sites.

Nunes could’ve stated that, all clarified things for CNN Viewers.
