The American Civil Liberties Union (ACLU) is suing to have illegal aliens counted when apportioning congressional representation.
On Friday, the ACLU dropped a lawsuit against the Trump administration on behalf of a number of open borders lobbying groups including New York Immigration Coalition, Make the Road New York, CASA, American-Arab Anti-Discrimination Committee, ADC Research Institute, and FIEL Houston demanding that illegal aliens be counted in congressional apportionment.
This week, Trump signed a memorandum to exclude illegal aliens from being counted when the federal government apportions congressional representation to the states a reversal of existing policy that allows states with large illegal populations to soak up more political power by counting all residents rather than legal residents.

Of course they are.
We had a USSC case already on this but presented in a different way.
Sounds like they want to bring back something like the “three-fifths” rule. Rich coming from the ACLU.
Please, US Supreme Court, don’t give them what they want.
I really don’t understand the reasoning behind this. Illegals aren’t supposed to be able to vote; why should they be counted in this?
The Constitution directs a census must occur every ten years, but beyond that...it’s not exactly written down on ‘who’ you count or don’t count.
Since it revolves around representation and voting....you’d only assume that citizens would count.
The problem here...if you figure timing, this case won’t get to the Supreme Court until the fall of 2021. By that point, at least one vacancy (maybe two) will be existing on the Supreme Court, and Trump (figuring he wins) will appoint only pro-positions on this topic. So even if Roberts does figure to go against the idea....there will five on the right who agree with Trump.
At this point, NY, California and Texas figure to be the losers (figure two districts lost to each state), and a major fight on all three for the new districts being drawn. Then the more curious situation will be Latinos/Hispanics demonstrating in this election....that more of them are pro-Republican than people had figured. The next decade promises to be a very interesting period.

I would think at some point illegal aliens would have to appear in court. Which would be a good time for ICE to be waiting at the court house.
This should be part of a Comprehensive Immigration Enforcement bill, missing since 1986 ONE TIME amnesty. Since that amnesty was granted already, a second amnesty is off the table. What remains is the enforcement the Democrats have disallowed since then.
The List of Comprehensive Immigration Enforcement, missing since 1986 goes like this -
1) southern barrier;
2) require eVerify to hire;
3) end all chain migration;
4) birthright per Minor v. Happersett (plural parents);
5) end work visas;
6) 10-year moratorium on all new applications for citizenship (40 years to allow workplace automation effects on downsizing population);
7) Set up an illegal aliens victim restitution fund.
Enactment of these provisions will motivate illegal aliens to SELF-deport, and remove colonizadors from our welfare rolls.
We need to pass these protections in order not to make out Democrats as liars who promised the protection in exchange for a ONE TIME AMNESTY. The Democrats got the amnesty already. Now its past time for the protections we were promised.
California has a lot of people that can’t vote. (They’re not supposed to, anyway.) Many citizens have left California for other states. If you count non-citizens for Congressional representation, it becomes a lot harder for places like California to lose seats in the House when the demographics shift. That affects what legislation passes and dies in Congress.
The “three/fifths” rule in the Constitution allowed states to count three out of five of their indentured servants/slaves in the census for representative purposes. It gave the Souh padded representation in Congress until the Civil War ended it.
