The Supreme Court on Friday denied an appeal by a Nevada church to allow additional worshipers to join in-person services based on capacity amid the coronavirus pandemic.
Nevada has placed a 50-person cap on all places of worship, no matter the capacity of the building, as a part of the state's coronavirus restrictions.
But casinos, along with other businesses such as restaurants and movie theaters, may permit up to 50 percent capacity, allowing casinos to grant access to hundreds of patrons at a time.
Justices Samuel Alito, Neil Gorsuch and Brett Kavanaugh all issued dissenting opinions rejecting the constitutionality of the decision.
This is a simple case. Under the Governors edict, a 10-screen 'multiplex' may host 500 moviegoers at any time, Justice Neil Gorsuch wrote Friday.
In Nevada, it seems, it is better to be in entertainment than religion. Maybe that is nothing new. But the First Amendment prohibits such obvious discrimination against the exercise of religion, he added.

Same thing applies to 2nd and we have accepted tons of restrictions on that right. Oh well, maybe Jesus will intervene since no one else seems ready to.
The brutal annihilation of Christianity is the core craving of the Democrat.
Dead girls or live boys. Only explanation.
Roberts is compromised. Find out what it is and FORCE him to resign/retire. (or commit suicide)
Oh, that will be great optics - LEOs bursting into a church service and arresting people.
That becomes more and more obvious every day. When he is no longer useful to the left, he will be exposed.
In their refusal to honor their oath to defend the Constitution, Vile Roberts and the USSC has proclaimed that the State -- not God -- is god ... and they proclaim the Constitution acknowledges this.
Vile Roberts needs to be exposed and forced to resign as the disgrace he is.
Churches apparently look to a different Constitution than the casinos do. Funny me; I thought there was only one. Can’t quite understand how one can take an oath to uphold the Constitution & still allow something like this. If there is a different constitution for Nevada, then isn’t it time it was published? Or maybe there is no law requiring a government official to uphold their oath of office? Or no punishment for not upholding it?
It’s just such a frustrating situation. Casinos are packed with people because there is really no way to keep track of the numbers in order to enforce the 50% guidelines.
My church is set up like an amphitheater with four sections of twenty rows with each row a little longer than the one in front of it. Only the first three rows are available for congregants.
We have to sign up to attend a Mass and are asked to only request no more than two a month.
I don’t know what our recourse is. The diocese is all in with Governor Sisolak’s orders. Not a peep from the bishop or any of the priests even though most of the churches here are huge and at 50% would hold several hundred.
I will only put money in a collection basket when I attend a Mass. I refuse to go online and donate to a church that won’t fight for my right to attend Mass.
The only rule in Nevada is the “golden rule”, those that have the gold make the rules. Casinos are the cash cow here with gaming and room taxes. The casino owners have let Sisolak know who’s the boss and he’s taken his petty anger out on churches and small bars.
The problem is that Nancy Pelosi controls the power of impeachment since only the House of Representatives can impeach. Roberts is a useful idiot for Pelosi.
He’s been the Chief Justice for 15 years now. I would think that it would have come out in all that time.
