Federal appeals court rules Trump admin can't withhold federal grants from California sanctuary cities

A federal appeals court ruled Monday that the Trump administration cannot withhold federal grants from California sanctuary cities, affirming previous rulings in the state.

The U.S. Court of Appeals in San Francisco said its ruling that the Justice Department cannot block police funds from cities not enforcing immigration laws does not extend nationally, Bloomberg News reported.

The decision follows rulings from three other regional federal appeals courts against the administration. But a New York court unanimously ruled in February that the department had the authority to withhold funds from the cities that do not comply with federal authorities' enforcement of immigration laws.

The 2nd Circuit Court of Appeals declined to reconsider its February ruling on Monday.

Bloomberg noted that the conflicting decisions make it more likely for the Supreme Court to eventually take up the case.

But the Supreme Court declined a request by the administration to review sanctuary laws in California cities last month. The denial allowed lower California court rulings against the administration to stand.

Is this the Ninth Circus?

I'll bet it's a three-judge panel.

The #FakeNews Media always pretends that it's the WHOLE circuit court - when it's only three judges pulled out of a hat...

Thought the supreme Court already ruled... Not that matters when it goes for this administration. Not sure why they don’t just withhold and sight the favorable decision

I have never been able to figure out why the DOJ does not charge the officials of those city’s with harboring and giving aid to illegal aliens. The penalties under the law are very high.

A precedent has already been set with the enforcement of the Federal 55 mph speed limit set back in the 70's.

Federal highway funds back then would be with held if the 55 speed limit was not set.

"I can't drive, 55!"

Why is harboring illegal aliens not a crime?

This should have been established long ago.

Where is the legislation to fix this?

Simple. The Deep State is firmly in with the Globalist Agenda. They are hoping to run out the clock on the President Trump era hoping for just four years but, planning to stifle his every move for 8years if they must.
What American Patriots must be wary of after Donald Trumps terms are over is, who the Globalist RINO’s will attempt to foist upon us. They did it once before. GW after Reagan who the RINO’s also despised.
We must be especially wary of the Stealth RINO candidate who runs as a Trumpian candidate but is actually a RINO Trojan Horse candidate. This is very likely to be the Establishment “republicans” ploy after President Trump finishes his two terms.

It was a little strange that the article did not say “9th Circuit Court of Appeals” but instead said “US Appeals Court in San Francisco”.

“Where is the legislation to fix this?”

There is no legislation that can be passed in America today.

Very convenient for our lazy ass, rich as sin, good for nothing politicians.

Appeal from the United States District Court for the Northern District of California William Horsley Orrick [ClownBammy Resistance "judge"], District Judge

Before: William A. Fletcher, Richard R. Clifton, and Eric D. Miller, Circuit Judges.

William A. Fletcher [Rapin Bill "judge"], Richard R. Clifton [senior Dubya judge], and Eric D. Miller [Trump judge].

Opinion by Richard Clifton in CITY & COUNTY OF SAN FRANCISCO V. BARR 18-17308

https://cdn.ca9.uscourts.gov/datastore/opinions/2020/07/13/18-17308.pdf

The panel affirmed in part, and vacated in part, the district court’s summary judgment entering declaratory relief for plaintiffs and permanently enjoining the U.S. Department of Justice (“DOJ”) on a nationwide basis from imposing certain conditions for providing funding for state and local criminal justice programs through Edward Byrne Memorial Justice Assistance Grants.

Yes, strange.

They're learning damage control.

See my post#12 for the play-by-play.

Looks like this is going up against the decision by the Second Circuit.

As Trump continues to replace federal judges, it is well to remember that problems like this are the result of 50 years of spineless Republicans rubber stamping ultra left judges put out by Democrat presidents. By going along to get along, Republicans have screwed us for at least two generations.

The average voter with the attention span of a gnat has no understanding of how critical it is that we have four more years of Trump appointments to the benches.

So why can’t the President just end the program all together. Let cities pay for their own stuff.

We should play their game and demand a full review by the
Ninth. And then move it to the SCOTUS, so Roberts and a few
other “Conservatives” can sell us out again.

The Federal Government has every right to expect the states
to obey federal law. If they don’t want to, let them do
without federal dollars.

Imagine acting like a real a. h. to your folks, and then
asking for the car keys to take a girl out on a date.
