Pardon Michael Flynn. Time for the President to end this highly politicized prosecution.

The prosecution of former National Security Adviser Michael Flynn has already exposed the bad faith of the FBI and Justice Department in pursuing him even when they knew there was no basis for an investigation. Now federal Judge Emmet Sullivan is continuing the legal torture by appealing an order from a panel of the D.C. Circuit Court of Appeals to drop the charges. President Trump should step in now and end this farce by pardoning Mr. Flynn.

In an honest process, Judge Sullivan would have signed off on dropping charges once prosecutors and the defense agreed there is no case to adjudicate. He refused. Mr. Flynn then sought a writ of mandamus from the D.C. Circuit, and he prevailed in a 2-1 opinion that ordered Judge Sullivan to dismiss the case.

Judge Sullivan is now refusing again by requesting this week an en banc review of the writ by the full D.C. Circuit. Though we don’t know whether the full court will take the appeal, remember that Senate Democrats and Barack Obama packed the D.C. Circuit with liberal judges after ending the judicial filibuster on a partisan Senate vote in 2013.

Judge Sullivan knows that once the court takes the case en banc, the panel opinion is immediately vacated under D.C. Circuit rules. That means the writ ordering him to dismiss vanishes, and the eventual en banc ruling would control. Mr. Flynn’s legal agony would continue for months and perhaps until a Biden Administration takes office.

This is outrageous and continues the politicized nature of this sorry prosecution. The review of the Flynn case ordered by Attorney General Bill Barr found the FBI and Justice Department withheld exculpatory evidence, revised the bureau’s 302 interview forms, and did an end run around normal White House procedures to sandbag Mr. Flynn.

Freepers are delusional. If he was appointed to any of these posts, Flynn would go down as the first presidential appointee in history who failed to get a single U.S. senator to vote for his confirmation. Even if everything goes his way and he’s completely cleared, the last 3+ years have exposed him as an embarrassment to anyone with an ounce of credibility.

His career in government is over — unless he was a stooge for the Democrats all along.

Abolish or split up the DC Circuit court. Form a different circuit court because DC is not a state and therefore doesn’t need a circuit court.

Congress establishes judicial circuits. Congress would have to disestablish it or split it up.

I disagree, if FLynn can be exhonerated by the system, that he can’t be appointed. I do agree that won’t happen, if Trump has to be the one to pardon him.

However, it’s hard to argue against appointing him if it was the system that cleared him.

He can be appointed. He’ll never be confirmed. Not only that ... he won’t get a SINGLE SENATOR to vote to confirm him.

The kindest thing I can say about the guy is that he comes across as an inept moron.

Agree. With a pardon he will not be able to screw Strzok, Page, McCabe, Comey . . . to the wall with civil lawsuits.

Regrettably, this is exactly right. Emmett Sullivan and his enablers and handlers keep doubling down on stupid; and they keep getting their arses kicked. It’s sad for General Flynn, a good man, but this has to go all the way.

No. Flynn needs to be fully exonerated. This is what the DOJ pulling the case did. Sullivan is being a jerk

Since case is still going through sentencing and hasn’t finished yet there is no need to pardon

It would be better to allow that jackass Judge Emmett Sullivan to continue his en banc petition to the end. If he gets his way, then take the case to the Supreme Court which would shoot it down and make a fool of him and his escapades.

a pardon at this point is a REALLY bad idea ... it lets that kommie judge, Emmet Sullivan, off the hook and leaves Flynn without final resolution of having all charges dismissed and never having convicted in the first place ... it’s the same reason Stone turned down a pardon ... Flynn has nothing left to loose by seeing this travesty to a fully just ending as Sidney Powell is working for him pro bono ...

exactly ... far better to see this travesty to it’s natural end with the appeals court ordering sullivan to grant the DoJ’s demand to drop all charges due to gross misconduct on the part of obama’s DoJ ...

totally ... WSJ must be trying to nuke Trump with this “advice” ... given WSJ’s any anti-trump stances, it’s always best to do the opposite of anything the recommend ...
