DC Circuit orders Judge Sullivan to grant the DOJ Motion to Dismiss.
They also "vacate the district court's order appointing an amicus as moot."
I have to correct myself....a 2 to 1 decision.
It ain’t over until the actual motion is granted.
Its over, but I don’t trust this one to be dead until its actually signed.
The court granted mandamus order to Sullivan to dismiss the case against Flynn, and it granted a mandamus order nullifying Sullivan’s appointment of an amicus to review and judge the DOJ dismissal request.
So Sullivan is ordered to grant the dismissal of the case against Flynn and ordered to dismiss the amicus he appointed.
What the DOJ and Flynn did not get was a mandamus order moving everything out of Sullivan’s court. However, given the language of the court in the mandamus orders to Sullivan, I think that the court may rule further against Sullivan if he refuses to implement the mandamus orders he was handed today.
That’s what makes this whole thing so crazy. AG BARR: I have never seen this before. That says a lot.

Case in 1957 essentially was in the same posture -- parties in a case were ticked at the judge for forcing them to a magistrate without their consent. They filed a writ of mandamus with the court of appeals, which granted it. The judge then filed his own appeal of the writ with SCOTUS, which heard the case on the merits rather than dismissing for lack of standing.

Bright side is that it wouldn't be tough to imagine a situation where the roles were reversed, and we'd be hoping for the SCOTUS to slap down an appellate grant of a Writ with which we disagree.

that’s because the appeals court wanted to jam their ruling down sullivan’s throat and MAKE him be the one to dismiss the case ... besides, a new judge would just prolong the whole thing for many more months ...
Neomi Rao’s majority opinion was amazing, completely demolishing sullivans illegal actions and completely dismantling his bogus response to the appeals court regarding the mandamus request ... this opinion is also a powerful addition to case law that will pretty much end all such shenanigans of activist judges to stick their noses into dismissal of cases by prosecutors ...
the other thing the opinion made clear that i didnt really understand beforehand, was that sullivan and gleason were ultimately trying to tie the DoJ into knots indefinitely by forcing them to defend themselves against an infinite and unending tsunami of accusations about this case and any other cases they so chose to attack ...
this is a gigantic win for the rule of law, separation of powers, and the U.S. Constitution, and would NOT have occurred without judge Neomi Rao, who was appointed by President Donald J. Trump.
Sullivan and his pals are clearly following orders issued by Rat Party Headquarters.But that shouldn't surprise anyone.

Did the appeals court give the judge a deadline to act?

Consider what would happen to you or me if we flipped off a court order. Whatever it is, probably time in jail, should happen to Sullivan.
So far the black hack in a robe has not dismissed the case.
And its been almost a week.
