Thomas, Kavanaugh lament 'decade-long failure to protect the Second Amendment'

Supreme Court Justices Clarence Thomas and Brett Kavanagh on Monday admonished their fellow justices for letting Second Amendment cases languish in the lower courts in a dissent to the tribunal's decision not to take up a gun rights case.

The last major Supreme Court cases to decide gun rights issues were McDonald v. Chicago and D.C. v. Heller, both of which came out more than a decade ago. Kavanaugh and Thomas, in the case of an ATM service worker who takes care of machines in "high-crime areas" but was told by New Jersey that is not a good enough reason for him to have a permit to carry a handgun, accused their fellow justices of ambivalence to potential violations of Americans' constitutional right to bear arms.

"This Court would almost certainly review the constitutionality of a law requiring citizens to establish a justifiable need before exercising their free speech rights. And it seems highly unlikely that the Court would allow a State to enforce a law requiring a woman to provide a justifiable need before seeking an abortion," Thomas wrote, in an opinion joined by Kavanaugh. "But today, faced with a petition challenging just such a restriction on citizens’ Second Amendment rights, the Court simply looks the other way."

Agreed, he’s been useless on a good day.

Still, we have three very solid 2A justices (Thomas, Kavanaugh, and Gorsuch), and one pretty good justice (Alito). When President Trump wins reelection and replaces Ginsburg and one or two others, we’ll have a court so pro-2A we’ll finally be able to strike down the GCA, NFA, and the anti-gun parts of FOPA. President Trump will bring us where we need to be so long as we all continue to stand with him.

There are many states where the citizens have been deprived of their 2nd Amendment rights and the Chief Justice is just fine with that.

They've been failing on the Second Amendment for decades.

Second Amendment violations are some of the easiest to spot; for example, how does anyone justify additional charges on firearms and ammunition? Could you imagine taxing the First Amendment?

Thomas and Kavanaugh would happily do it today. Just put a case in front of them. That’s two votes. Gorsuch could easily be talked into it. That’s three. Replace two liberals (or one liberal and Roberts, who may as well be) with Trump appointees and that’s 5. Alito won’t be on the wrong side of that one, so that’s a 6-3 in favor.

One more pick by President Trump gets us picking away at GCA/NFA/FOPA. Two more and they’re absolutely gone.

Having the court take these cases before they have a majority to rule in the right way would be worse than ignoring them for now. That may be why they aren’t being heard.
