Retired judge calls effort to drop case against ex-Trump adviser 'gross abuse' of power

WASHINGTON — A retired judge on Wednesday urged a federal court not to allow the Justice Department to dismiss its criminal case against President Donald Trump's former adviser Michael Flynn, citing evidence of a "gross abuse of prosecutorial power."

The U.S. district judge hearing the case, Emmet Sullivan, last month tapped John Gleeson to serve as a "friend of the court," after the Justice Department abruptly asked the court to dismiss the criminal charge against Flynn, a former national security adviser.

The stunning move by the Justice Department followed a pressure campaign by Trump and his conservative allies and came even though Flynn had twice pleaded guilty to lying to the FBI about conversations with former Russian ambassador to the United States, Sergey Kislyak. Gleeson was tasked with arguing against the government's motion, and Sullivan also asked him to make a recommendation on whether to hold Flynn in contempt for perjury.

"The government has engaged in highly irregular conduct to benefit a political ally of the president. The facts of this case overcome the presumption of regularity," Gleeson wrote, noting that Sullivan should proceed with sentencing Flynn.

Flynn was one of several former Trump aides charged under former Special Counsel Robert Mueller's investigation that detailed Moscow's interference in the 2016 U.S. presidential election. He was Trump's national security adviser briefly in early 2017.

Gleeson also said there was "ample evidence in the record that Flynn committed perjury," or lying under oath. But he recommended that Sullivan take Flynn's perjury into account when sentencing him for lying to the FBI, rather than commencing a follow-on prosecution.

We will see where this goes. I hope dismissal. Flynn charged. Flynn pleads guilty under oath freely and voluntarily. Flynn seeks to withdraw a plea claiming mislead by former counsel and bad faith by gov. Judge orders all parties including former counsel to file explanations before revoking the guilty plea. Gov responds not with an admission of wrong doing but merely stating essentially, “we are not interested in pursuing the case anymore.” To me it seems the court is saying, has there been a fraud on the court, by whom and how? In the meantime, the court has Flynn in a bind. Does he also have the Gov in a bind? the former attys? Fraud on the court is extremely dangerous. Remember, the Gov hasn’t admitted doing anything wrong. Now the story is that they re-evaluated the case.

So, if you falsely fire one of my employees, and I complain long and loud about the unfairness, then it is corrupt if the prosecutors independently discover it was a covert corrupt prosecution and drop the charges???

That’s the dumbest thing I’ve ever heard.

We should continue with what we know to be a kangaroo prosecution based on lies, and we should send a known innocent man to jail?

Former advisor??? Michael Flynn was the National Security Advisor to the President of the United States. He was sitting in his WHITE HOUSE office when he was ambushed by coupist FIB agents.

The strangest aspect of this case, which has a great deal of twists and turns already, is why Sullivan is holding onto it well into two and a half years. He complains about the DoJ wanting to drop the case, but he let it linger for so long that they were able to get all the information to show the past prosecutorial abuse.

And in his brief to the court last week, he asked them to at least give him a chance to make a decision, and if it was wring, they could reverse it. But, he's had plenty of time.

One theory is that as long as Flynn's case is open, he cannot speak about it, and that would be motivation to keep it dangling for all this time.

I just don't know. It's the strangest case I can think of from a legal process point of view.

There are some unreported problems with the plea that this judge points out. When entering a guilty plea in Federal Ct. the party/defendant is sworn and then under oath admits guilt along with facts that support the plea of guilty. Flynn, under oath and with facts, admitted guilt. You are also asked if anyone or anything coerced this plea. Flynn said no. As I state this, please be aware that it is difficult to change a guilty plea. There were obvious shenanigans in this court. Shouldn’t the court get down to the reasons? The gov just asking for it to go away is not always sufficient.

Look, Oystir, if you say ANYTHING different than what was agreed to in the plea bargain, the plea bargain is null and void. GET IT???? That is a REQUIRED PART OF THE PLEA BARGAIN! He cannot state anything different in court than what the prosecutors tell him to say. GET IT?????

NOW get a brain.

Did you read the filing the DOJ made to Judge Sullivan in requesting the dismissal. I’ve read every filing. It has LOTS of evidence of wrong-doing on the part of the prosecution as part of its reasoning for dismissal, and the reason—which they are NOT required to file at all—for withdrawing the case. Multiple cases and precedents allow the government to withdraw cases prior to sentencing in the interest of Justice. That is what they are claiming.

Sydney Powell misspelled "ipsa" on twitter but I know what she means.

I sincerely doubt that Attorney Sydney Powell misspelled that word. Try it sometime on a computer and you’ll find the computer auto spell check converts it to ipas, the plural for a light beer. It does on my computer and it also does on many uploads, automatically. They don’t recognize Latin. LOL!

Gleeson is insane, which is why Obama and Sullivan picked him to do something that is procedurally unethical and possibly illegal.

Sullivan will get his very soon when official complaints from DOJ, filed with the Judicial Council (or whatever the name is for the official group who hears ethics/malpractice complaints filed against them by other judicial persons).

Hopefully he will be disbarred and thrown out of the court.

As for Gleeson, he might get his kick in the ass from a higher court who realized that he is insane and dangerous.

Oh, I certainly get it and I hope the appeals court moves quickly for a dismissal. I also believe that it is highly unfair that Flynn is left dangling. I was just trying to give you the legal/fact that the procedure of withdrawing a guilty plea is NOT so simple. Unfortunately, this “independent” judge says so too. In fact, this idiot says no to a withdrawal - go strait to sentencing. A withdrawal leads to the Gov having to prosecute a case they now don’t believe in. This judge says no trial. Go to sentencing and that Sullivan can take Flynn’s court behavior against him as he is showing no remorse.
