Dude, the autopsy report does NOT say the drugs were in amounts that would cause death. So they weren’t the cause of death and it most definitely says Homicide for manner of death.

It’s called “restraint asphyxiation” which is a form of positional asphyxiation. All restraint asphyxiation is homicide since it requires the use of force by a third party that prevents the victim from repositioning himself.

Manslaughter seems off the table now because you can't prove beyond a reasonable doubt that the officer's actions, excessive or not, were necessary and hence a cause for the death to have occurred when it did. And ... the official M/E says 'not strangulation'.

Civil case likely a slam dunk, although arguable that it shouldn't be for the killing. But 12 jury members? Beyond a reasonable doubt? Where's the evidence that the knee caused it when the examiner autopsy says 'not strangulation.' Hmmmm, I don't know how a jury goes on this one.

There are alternate camera videos of him repeatedly staggering and falling down prior to the main event, each time, the cops were picking him up and trying to get him to squad car.

But no one will care.

The only people or needs to care is a jury or a judge, whatver the defense decides on to hear the case.

He was not merely charged of home invasion; he was CONVICTED and served his whole sentence. If you think he shouldn’t have been walking around, take that up with whatever state he was convicted in, for making his sentence too short.

...btw, did the police arresting him know about this at the time?

Or did someone rummage around in a filing cabinet and put that in a press release so they could get everyone all mad at him, to get the civil-rights-violating, murderous cop off the hook, and cover for the fact that the county attorney who did NOT prosecute the cop for his 10 previous excessive force instances, was a front runner for VP under Joe Biden?

Minnesota statutes do not require intent but depraved indifference.
The cop kept his neck on the guy’s neck for over 2 minutes AFTER his fellow cop told him the handcuffed guy on the ground didn’t have a pulse.

Not even an attempt at CPR.

That’s from the Probable Cause doc charging him with 3rd degree murder, and in front of multiple witnesses, and on video.
