1st and 2nd degree murder require the intent to kill.

There will never be evidence of that.

Never let the truth get in the way of a good headline.

Floyd pleaded "I can't breathe," as Chauvin, who is white, kneeled on Floyd's neck for around eight minutes

The media will do anything to stoke further ire. Was it really necessary to state the officer's race? Why is that relevant? If he was black, his actions were still inappropriate.

That said, I really hope they have a solid case. I seem to recall something like this happening a few years ago, maybe Baltimore, where an officer was prematurely arrested, and the trial ended with an acquittal or hung jury which resulted in further riots.

They probably don’t want to be reversed on appeal. At least that’s my guess.

Like pointing out the arrested CNN reporter is black/Latino but not mentioning his white crew was also arrested?

Once the State is finished with him, Chauvin will be prosecuted under Title 18 U.S. Code 242. Because George Floyd died, the federal penalty will be "shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death."

If Chauvin ever gets out of prison, he will be a very old man.

I feel sorry for his wife and family. Would not blame his wife if she filed for divorce in the very near future. Best way for her to preserve her half of the assets because Chauvin's legal bills are going to be huge.

Here is the pyramid of blame/responsibility in Minneapolis!

1. The officers that did the choking/killing. They apparently did it.
2. The police department heads, and their Chief. They are responsible for the environment that lead to the officers believing this was acceptable behavior.
3. The soy boy mayor, Jacob Frey
4. The soy boy mayor, Jacob Frey, who selected the Hispanic Chief of Police, Minneapolis Police Chief Medaria Arradondo.
5. The Minneapolis Police Chief, Medaria Arradondo, After Not Giving Cops Armor, Chief Medaria Arradondo, Said, The Riots were “Too Dangerous For Cops To Stop without body armor!”
6. The voters of Minneapolis. They elected the mayor, who hired the Chief of Police
7. The local mediots on tv and in news papers ignored 1-6 until the riots started.
8. This isn’t even a state issue, much less a fed/gov issue. It is a Minneapolis issue and liberalvoters’ issue. Elections have consequences!

9. The good news for Karens in Minneapolis, FR and in America, the cops and rioters are wearing masks and apparently trying to staying 6’ part during the looting and rioting.

10. Minn. soy boy mayor, Jacob Frey gives masks to crowding rioters after warning in-person worship would be ‘public health disaster’!

Minneapolis Mayor Jacob Frey (D) requested on Thursday that “protesters” in the City of Lakes practice social distancing and wear masks to reduce coronavirus ...

10 a. Grandpa Dave.. forgot to mention..: masks are helping to make sure that any video surveillance footage would NOT allow rioters and looters to be identified thanks to their masks.

The Karens in America are cheering this great leadership. Masks are for everyone!

“All of that has come together and we felt, in our professional judgement, it was time to charge.”

I'm sure the events of last night has shaken the weak city and state leadership right down to the inserts in their Roman sandals.

It is their hope that this announcement will forestall more violence tonight as National Guard troops have moved into position to defend the ruins of the city police department.

Still, the announced charges are a big comedown from the first degree murder charge demanded on this site.

Have you heard the audio?

I think the cops’ defense is likely to be that the suspect “failed to follow police instructions.”

Have seen all sorts of violent mahem including negligence leading to homicide (against whites) defended at the local level by cops, PBA and their friends because suspects allegedly didn’t follow officers’ instructions.

“He has been charged with 3rd degree manslaughter not murder!!!”

A prosecutor has to go with charges he believes he can get a conviction on. Depending on the facts, which we don’t know yet, it may be impossible to get a murder conviction. For example, suppose the autopsy shows that the victim did not suffocate, but died of alcohol toxicity or a heart attack? Then, although the rough arrest didn’t help, it also didn’t necessarily cause the subject to die. Murder would be thrown out of court.

” I don’t know why 4 experienced police officers couldn’t subdue a suspect without kneeling on his neck.”

Maybe kneeling on his neck was all they could do short of shooting him, and only one person could kneel on his neck at a time?

2019 Minnesota Statutes

609.195 MURDER IN THE THIRD DEGREE.

(a) Whoever, without intent to effect the death of any person, causes the death of another by perpetrating an act eminently dangerous to others and evincing a depraved mind, without regard for human life, is guilty of murder in the third degree and may be sentenced to imprisonment for not more than 25 years.

For a person with no criminal record, sentencing guidelines call for 150 (128 to 180) months. Note that Officer Mohamed Noor, who shot Justine Diamond, was charged the same and received exactly the recommended sentence of 150 Months. 2/3 of the sentence is mandatory, so he would be eligible for parole after 100 months.

“Gotta admit, that video is pretty strong though.”

Agreed. Take race out of the equation. I didn’t like what I saw. He was already handcuffed and lying on the ground. A knee to the neck with body weight behind it was uncalled for at that point, especially with other officers right there.
