Flynn prosecutor's contested claims impacted judge's pivotal December opinion, FBI docs suggest

Newly released FBI documents suggest a federal judge in Washington was swayed by apparent misrepresentations from a top prosecutor when he issued a memorandum opinion in December 2019 -- a ruling that marked one of the lowest points in former U.S. national security adviser Michael Flynn's effort to withdraw a guilty plea on a charge of lying to investigators.

In the pivotal Dec. 16, 2019, memorandum opinion, D.C. District Court Judge Emmet Sullivan denied Flynn’s request that the government be compelled to search for and produce additional exculpatory "Brady" material. That decision now appears to have been heavily based on inaccurate or misleading claims by top prosecutor Brandon Van Grack.

Van Grack, a former member of Special Counsel Robert Mueller's Russia investigation team, was abruptly removed from the Flynn case on Thursday after Fox News highlighted his apparent noncompliance with Sullivan's February 2018 order to produce Brady material. The Justice Department then dropped the Flynn case entirely, as a mountain of striking exculpatory evidence had emerged -- including a handwritten note from a top FBI official debating whether the bureau's objective was to "get [Flynn] fired."

They aggressively argue a contrary point of view. They do this by staying in the weeds and failing to even discuss the greater picture in which the facts add up to a very dangerous politicization of law by our nation's law enforcer. I am satisfied that the Barr version is persuasive even if one stays in the weeds. Anyway, a look at The Atlantic articles will give you the other side of the story.

In my world, the judge will issue the mother of all dismissals and will put a genetic smackdown on the DOJ and the FBI agents who have publicly made a fool of the judge, and sadistically crushed the rights of an innocent man.

Even now, too many are not taking this treason seriously. I hope its because they do not understand what happened, exactly.

“They” get the stories from our MSM. “They” therefore believe Trump is corrupt and stupid.

I know some otherwise-intelligent men that listen to NPR, have TDS and cannot be reasoned with. Same goes for Europeans with their MSM and opinions.

Primarily, blame our pubic school teachers for their leftist indoctrination of our children over many decades.

Just finished season one of Showtimes “Billions” where Paul Giamatti plays the US Attorney in New York and whoever wrote the script for this knew exactly how the US Justice department works. The anything goes attitude and the get down and dirty methods are all there and it’s no wonder that Herr Mueller and his gang of US Attorneys railroaded General Flynn, Roger Stone and others.

I wouldn’t be surprised to find out that Andrew Weissmann had a lot of input to the shows writers, it’s how they do things and they are convinced that they are the good guys and everyone else has been bad or will be. With them the line between right and wrong is something they can redraw whenever it suits them.

Thanks for the link to a contrarian (demonkrap) perspective. It is important to know what the other side is thinking, saying and doing.

I read only one of the articles. It appears that the author is doubling down and still promoting the left’s hoax that HRC lost b/c Russia elected Trump, and if Mueller had no limits they would eventually have found the evidence. This reminds me of the 2000 Florida recount. If they just kept counting the ballots, eventually they would get a count to show that Gore won. Almost 2 dozen recounts later, Gore still lost. Only here, this case is even worse. (ignoring their own crimes prior to the election), since their political opposition did not commit a crime before the election, a crime had to be created in order to get to the true target - Trump. Either getting Trump to resign, be indicted or totally undermine his term to make him ineffective. We wasted 3 years of his 4 year term on this - hence they partially succeeded.

So the author starts (again) with a false premise, the conclusion can never be correct. There is nothing new here, not even the fact that the other side continues to sprout their untruths and propaganda is not new. The definition of insanity is doing the same thing over and over and expecting a different result. The author must be insane. And that’s what I felt like reading the article - nothing ever changes on the left despite overwhelming evidence to the contrary. Ask Alger Hiss.

You are right, the author stays in the weeds, probably is smoking the weeds, fails discuss why there should be any concern that agents in OUR government were not investigating a crime, but actually looked to “make” a person to commit a crime. And not just any person - but someone very close to the newly elected POTUS. Yes, but it more than a failure to discuss the dangerous (criminal) politicization of the law. Should we not also ask, when else has this happened, and to whom at the federal level - especially by obozo? And the lawyer who lied to the judge about how all Brady material was turned over was also a key member of “beyond my purview to answer” Mueller team?

All these leftists wanted Mueller to charge the POTUS with obstruction of justice for firing Comey. They should be asked, if the POTUS could be charged with obstruction, why cannot you, obozo federal prosecutors and FBI agents be charged with obstruction of justice? AFter all, Nancy said no one is above the law. But asking them these questions expecting a truthful answer, let alone an answer different from their propaganda, will do nothing but perpetuate the insanity. Forget arguing with the left. It is the average citizen to whom one must address these questions, to counter the left’s propaganda at all turns, at all times. Eventually in time, like their defense of Alger Hiss, their position will become known to all, including themselves, as a crackpot position. What a way to go down, down in history.

Something like this happened to Senator Ted Stevens, at the end of W’s term (12 years ago!). Nothing apparently has changed in the DOJ and FBI despite the claims that they took action. No one who committed the crimes against Stevens and the American people, and the citizens of Alaska, went to prison. Unless justice is served this time, be not surprised that it will happen again.

The bottom line here is that the FBI needs to be shut down. Absent that, the entire DOJ should be effectively shut down by jurors in Federal cases refusing to convict anyone in a Federal trial.
