Alito orders Pennsylvania to respond in case asking Supreme Court to halt enforcement of stay-at-home order

Justice Samuel Alito this week ordered the Pennsylvania government to respond to arguments from a variety of Pennsylvanians asking the Supreme Court to halt enforcement of Gov. Tom Wolf's strict stay-at-home order, aimed at fighting the coronavirus, because they say it is unconstitutional.

The Pennsylvanians behind the suit – called petitioners in Supreme Court parlance – are arguing that their rights under the First, Fifth and 14th Amendments have been violated through Wolf's order. The petition lays out a variety of grounds on which it says the order is unconstitutional.

"[T]he Order violated the Petitioners rights not to be deprived of their property without due process of law guaranteed by the [Fifth and 14th Amendments], the right not to have their property taken without just compensation guaranteed by the [Fifth Amendment], their right to judicial review guaranteed by the [5th and Fourteenth Amendments], their right to equal protection of the law guaranteed by the [14th Amendment], and their right to free speech and assembly guaranteed by the [First Amendment]," it says.

That says it all in my book.

How long until a fake virus is used in fiction (TV or movie) to just take over the USA?

Or worse, in reality.

Here, unser Fuehrerin unilaterally ordered an almost complete shutdown of the state without anyone's by-your-leave.

This is an interesting precedent. A governor, by himself, can order a state of emergency for any reason whatsoever (justified or not), assume dictatorial powers, and punish anyone who dares gainsay him.

All he has to say is "It's for the general good".

What has become of our once free nation?

Ahh ... at long last. The weather must be warming up in Pennsylvania, and with the days getting longer and the novelty of house arrest with the kids (and also with the spouse, to which I can attest) wearing thinner with each passing day ... we’ll likely not need formal judicial involvement to force the obtuse governors to back off what they must surely know are uber-Constitutional diktats ... the voters will damn-well see to that eventuality themselves.

Too bad the Supreme Court only rules on constitutional matters. Wolf and everyone in his administration advising him to shutdown PA should be thrown in jail for a very long time. That would be justice and ensure that this type of thing never happens again.

The court’s decisions will set precedent for all future shutdowns. I hope they have some talented attorneys to argue their case.
