President Trump Threatens to Adjourn Congress: “They’ve Been Warned and They’re Being Warned Right Now”… (WOW!)

The last time the Supreme Court ruled on an issue related to congress not formally adjourning session they left open the door to support Executive Branch invocation of Article II, Section 3, during an “unusual circumstance” or “national catastrophe.”

Today President Trump warned congress he may invoke Article II, sec 3, due to the COVID-19 crisis and his need for administration positions that have been delayed by democrats in the Senate for more than two years.

The coronavirus pandemic would seem to qualify as an “unusual circumstance” where recess appointments would be needed, valid and justified. However, senate democrats would likely fight any attempt in court. The Senate has refused to adjourn session since President Trump was inaugurated, and multiple cabinet officials have been blocked from confirmation.

According to Politico:

“Leader McConnell had a conversation today with the president to discuss Senate Democrats’ unprecedented obstruction of the president’s well-qualified nominees and shared his continued frustration with the process,” said a McConnell spokesman. “[McConnell] pledged to find ways to confirm nominees considered mission-critical to the COVID-19 pandemic, but under Senate rules that will take consent from Leader Schumer.” (link)

After the prepared remarks from President Trump, he explained why he is now looking strongly at the possibility of triggering the forced adjournment:

I think that Trump is reaching the limits of his acceptance to “play nice.”

The other day he commented that Mutiny on the Bounty was a favorite movie of his. The message to Nancy and Chuck was clear......get with the program or I will consider this a mutiny.

Now he has told them to shape up or he will take control.

We need a President like Trump to shake up both Republicans and Democrats so that we start to get bipartisan legislation and focusing on the real problems.

Go Trump.

The dems/media created a HUGH national emergency out of the flu, and now Prez Trump is “not going to let a good crisis go to waste.”

He fooled them again.

Adjourn congress Mr. President. Apparently the Speaker of the House is only interested in shopping.

Do it ASAP.

Both Houses of Congress are not adjourned and they are both holding pro forma sessions at the current time. “Either house can hold a pro forma session at which no formal business is expected to be conducted. This is usually to fulfill the obligation under the Constitution “that neither chamber can adjourn for more than three days without the consent of the other.” Pro forma sessions can also be used to prevent the President pocket-vetoing bills, or calling the Congress into special session. Pro forma sessions have also been used to prevent presidents from making recess appointments.
In 2012 Obama attempted to make four appointments during a pro forma session, calling the practice of blocking recess appointments into question However, in 2014 the Supreme Court determined that the President had improperly used his presidential power to make these appointments, stating that while the Senate was in recess punctuated by pro forma sessions the period of time between the sessions was not long enough to invoke such power.”—Wikipedia

Either the Senate is in session or it is not. If they claim to be in session but will not actually meet and will not formally adjourn, then have one of the Republican senators make a quorum call every hour until they do one or the other.

You don’t get it. The reason for adjournment is so Trump can make recess appointments. It cannot be done while the Congress is even technically in session.

Which is probably why he is meeting with McConnell. If the Senate wants to adjourn, and the House does not, there would be the necessary "disagreement". Depends on whether Senate rules on a motion to adjourn require a simple majority, or are under the "filibuster" and two-thirds majority one.
