Trump threatens to adjourn Congress to make recess appointments

President Trump threatened on Wednesday to take the unprecedented step of adjourning Congress with his executive powers so he can make recess appointments of stalled nominees.

Speaking at the daily White House coronavirus task force briefing, Mr. Trump said his administration has been hamstrung by a lack of personnel because Senate Democrats have held up nominees.

He criticized the Senate and House for holding “phony” pro forma sessions, instead of adjourning, which prevents him from making recess appointments.

He can convene them in special session for emergency reasons.

Since they're not officially recessed I don't think Trump can convene Congress.

There’s no speculation about Foremost Group, it’s ties to the Chicoms and the fact the Chao family profits are directly tied to trade between the US and China. You can speculate all you want about Mitch not knowing his wife’s stake in the family’s billion dollar business. Just look at all the efforts Mitch has led over the past 20 years to make sure trade between the two countries is fair and equitable. Yeah, right.

Other math? Could a huge Chinese shipping company exist outside the direct influence of the Chinese Communist Party (CCP)?

Are there more connections? Clintons? Gore?   Perkins Coie, the registered Foreign agents of the CCP? Obama?

I read the Atlantic article and it is not the same situation as the present day. If President Trump were to use his constitutional authority (and even the reporters when asking him about it said he had it) and adjourned Congress, he would be in the right. He would then have the further authority to make recess appointments.

The argument might be made that it would “poison the well” between him and the dems in congress, but I doubt that it could get much worse. After all, they made impeachment articles out of whole cloth. And it is a disgrace that the senate has not given and up or down vote of some appointees in 3 plus years.

McConnell himself has already used the nuclear option multiple times to speed things along in spite of the unprecedented level of obstruction

Actually our new hero of the Senate, Linda reinstituted the blue slip hold power that Grassley had denied, which lets Senators block anyone. Insane policy but there you go.

I think it will be eventually ruled unconstitutional, but the election will be over before it gets heard by scotus.

The recess intent had to do with great travel times in early America.

President Trump doing this might get a hearing on BOTH, this and the Senate filibuster, though.

That would be worth it.

As was laid out in Peter Schweizer's book Secret Empires, the control over McConnell is indirect.

Elaine Chao's father owns a shipping company whose business is totally dependent on the Chinese government. Also, Chao's sister sits on the board of directors of the Bank of China.

McConnell knows that his father-in-law's livelihood is 100% dependent on the "good nature" of the Chinese ruling class. If McConnell makes waves against the Chinese inside the Senate, he knows that it will bankrupt his father-in-law.

That's the influence over McConnell; it's not a direct cash-for-favors arrangement.

OK...thanks. Ultimately, it's up to the voters and McConnell will win reelection easily in November. So there is that little detail. There are millions of Chinese descended folks in the US with ties to China. From reading the posts over the years, most would be happy to gun down most of them - but that is probably not practical and a bit messy.

We should really be most concerned about the college students that come over by the hundreds of thousands every year and spy on our research universities as they participate in their own research.

Also, the complete and colossal error in allowing the Chinese to roam all over the place. I have a friend who headed up a supercomputer development project at IBM - a years long effort. We were chatting one night when he mentioned there were several Chinese in a visiting delegation that was going to get a debriefing (for lack of a better word) about the project and a look see at what it can do. I was appalled and asked him how could IBM allow the Chinese to be there. He said we are keeping an eye on them. We are our own worst enemy.

First, he can definitely force Congress to close, that's not the legal issue.

What he can do is appoint them now, anyway. They are already adjourned, so there's a separate Constitutional issue with neither House obtaining permission from the other to adjourn for more than 3 days. A "pro forma" session that they're doing now is bullshit. They have to have a quorum for Congress to be "in session", even if that's just long enough to say we're here, goodbye, which is what a pro forma session is. Having 3-5 Senators from DC/VA/MD/whoever's nearby do it is invalid, since they don't meet the membership requirements to be in session, and therefore can't gavel in the session, pro forma or not.
