Presidential Authority to Call a Special Session of Congress

The question has been raised as to whether the President has authority to call a special session of the Congress in view of Senate Concurrent Resolution 33, pursuant to which the Congress now stands adjourned. That resolution provides that the Congress stands adjourned until January 2, 1948, unless in the meantime the President pro tempore of the Senate, the Speaker, and the majority leaders of both Houses jointly notify the members of both houses to reassemble. Article II, Section 3 of the Constitution provides that the President may, on extraordinary occasions, convene both Houses, or either of them, and in case of disagreement between them, with respect to the time of adjournment, he may adjourn them to such time as he shall think proper. The following provisions of the Constitution are also pertinent: Neither House, during the session of Congress, shall, without the consent of the other, adjourn for more than three days . . . (art. I, § 5, cl. 4).

I’d love to hear what Ted Cruz has to say about this. Like him or not, he’s got a sharp mind when it comes to constitutional matters.

Not much to say. Article II is pretty clear when it says that the President "may, on extraordinary Occasions, convene both Houses, or either of them..."

This power has never been used before in our history. It was put in specifically in case of a out of control congress.
Do you think that this congress is out of control? I do. Its been out of control since last summer...or last election.

Trump might as well shoot the moon. The dems/stooge press can’t afford any distraction to their Wuhan plague mega smear against Trump. They might mention this for a day or two but it will continue to be the full court press on Trump’s caronavirus massacre.

They are in recess, but did not officially call it that so much that needs to be acted upon is in limbo. It was likely done on purpose to keep the President’s hands tied.

He just told them to get back to work, or else.

That is correct. All he has to do is say, you need to get back into session by such and such a time or else.

They dont, and he can adjourn them till next Jan when they convene to swear in a new congress.

He shall from time to time give to the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient; he may, on extraordinary Occasions, convene both Houses, or either of them, and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper; he shall receive Ambassadors and other public Ministers; he shall take Care that the Laws be faithfully executed, and shall Commission all the Officers of the United States.

I guess it is good that there will not be any more Shenanigans by Pelosi or Schumer. The added bonus of being capable of a recess appointment should Ruthie expire during the recess. Up till now, McConnell had been keeping the Senate technically in session.

When I read this, an old quote came to mind: “The threat is stronger than the execution.” This feels so much like a President Trump move to get his enemies and roadblocks to make a move they’ll live to regret or die trying. Gonna need MORE popcorn!

We have serious problems currently facing our country. Congress should be there, in D.C., on the floor of the House and Senate, working on it. Trump wants to open the country back up? Start with Congress.

The answer is yes—but only under, certain unusual circumstances. These conditions are so limited that a President has never exercised the power to adjourn Congress.

The Senate Parliamentarian, Charles Watkins, said today that under the Constitution the President might adjourn Congress “to such time as he shall think proper” in the event the House and Senate were locked on an adjournment date.

HUH? The Cubanadian?

Mr. Constitution???

Doesn’t even know that to be eligible to be president that you have to be born in the United States not CANADA?

Actually, I’m sure he knows this. Sticking up for Cruz, way back when, I said that such a man of character, a man who knows the constitution, will not run for the office that he KNOWS he is not eligible for.

WHOOPS, guess I was WRONG! Not wrong that he wouldn’t run, no, wrong that he was a man of character, a man who knows the constitution.

Respect is EARNED! I doubt he could EVER earn mine back.

Why don’t NEWS outlets, draw attention to the fact that Donald J. Trump has chosen to stay at the White House..and not go to his PLUSH hotel in Florida and give his Pressers. How many others have chosen to stay at the Capitol..AND HE DOESN’T TAKE ANY MONEY FOR HIS SERVICE.

Really can’t name one thing Congress has done to help AMERICANS and America in this whole episode. They can all be lined up out front of the Capitol and be tar and feathered for all I care.

He can adjourn Congress and appoint recess appointees. That is what he threatens tonight. The Constitution gives him that right.
