Full D.C. Circuit to review Trump's border-wall spending 'If these executive actions are undone, our nation's safety could be in jeopardy'

The full D.C. Circuit Court of Appeals will review a ruling upholding President Trump's authority to use appropriated funding from Congress to build a wall to secure the southern border.

The U.S. House, led by Speaker Nancy Pelosi, is appealing a lower-court decision in its lawsuit against Treasury Secretary Steven Mnuchin.

The Democratic-led House alleges Trump's declaration of a national emergency to tap military funds for a border usurps Congress's constitutional authority to appropriate funds.

The American Center for Law and Justice filed a brief in support of the president.

Not only have Pelosi and her "extreme" colleagues "refused to to their job by addressing the situation at our southern border," ACLJ said, they have been trying to block the president's moves for security.

It'll go to the Supremes if they go partisan, and I don't think the DC Circuit will want to get spanked at SCOTUS.

A declared State of Emergency is literally a statement that he is abrogating the law and operating outside of it. Therefore, the courts have zero standing to “rule” on whether or not his actions are legal. Of course they are not literally within the law.
It is an operation under an emergency order.

This is completely constitutional. If the president’s acts under an emergency proclamation are corrupt, despotic, or unjustified, Congress can over-rule his emergency proclamation with a 2/3 vote. Failing that, the house could impeach with a simple majority and remove him.

There are plenty of checks on a president wielding emergency powers. But the judiciary is not one of them.

On the other hand, Gorsuch has played the libertarian card a bit too wildly for me to have faith in SCOTUS, while Roberts can go either way as well.

Well, the Covid-19 should be on the minds of any judge that considers this insane litigation by the Dems. Yep, if Mexico was experiencing the same rate of infection that Spain is, who would not want the wall from sea to shining sea. The Mexicans would be streaming across our border to escape and get to a place that at least had a hospital just like the New Yorkers are streaming out of Manhattan.

Going NOWHERE!

Even “IF” The DC Circuit rules against Trump, it will be stayed per appeal to SCOTUS.

At such a time as THIS (Coronavirus Plague) they wouldn’t DARE slow border wall construction. If it wasn’t an “emergency” THEN, it certainly is NOW!

This has ZERO merit. It will lose at the DC Circuit and definitely lose at SCOTUS.
