Actually, that's not what it says. That was what the leftists said you can not do - and the Supreme Court didn't overrule that. What they said is that if you use someone else's SS number for any purpose, the state can prosecute you for identity theft whether you use it for employment purposes or any other.

Compliance with federal employment requirements (including confirming legal right to work in the US) is for the federal government to address. But the leftists said that because that was one aspect of the problem of using a stolen SS number, only the federal government could prosecute use of SS numbers.

Instead, the USSC said that the states can prosecute for other-than-federal-employment-violation crimes if they have laws that were violated - and identity theft is such a law.

Yes I get that. I was referring to the fact that the Kansas SC ruled with the illegals in the first place. We have the wicked Kathleen Sebelius to thank for that no doubt.
