The D.C. Circuit Court of Appeals will rehear arguments in two Trump administration cases over a House subpoena to White House counsel Don McGahn and funding for a southern border wall.
The court vacated previous rulings in both cases on Friday, according to Politico. Arguments for each are scheduled for April 28 in front of the full D.C. Circuit.
House lawmakers petitioned the court last week to revisit a lawsuit to force McGahn through subpoena to testify to Congress. A divided three-judge panel ruled on Feb. 28 that the Judiciary could not decide what amounted to a political debate between two coequal branches of government.
The ruling was a major victory for President Trump. The House subpoenaed McGahn last night while investigating Trump on impeachment charges related to his foreign policy with Ukraine. Trump claimed executive privilege over McGahn’s testimony, resulting in the House lawsuit.
The second case due to be reheard by the D.C. Circuit is over whether Congress can sue to block the Trump administration from diverting unspent military construction funding toward building a wall on the United States-Mexico border.

As all of us are adjusting to the surreal experience of the Chinese virus, this strikes me as sheer evil. The anti-American activists who are in charge of strategy for the Democrat Party have no ideology; they are nihilists. They live and breathe destruction. The contrast between this non-politician, billionaire President and those who seek to destroy his Presidency is so clear that one has to be asleep not to see it.
Only when Trump wins is the panel "divided". If they rule aginst Trump, then it's just "A three-judge panel ruled". This is the same strategy the 9th Circus uses, where any important case where a 3 judge panel rules for conservatives, the case is re argued "en banc", in front of the full court. The DC Circuit makes the 9th look conservative, so Trump will lose.
He can take it to the SCOTUS!!! If I were Trump at this point I would just say SCREW THIS and go back to the wonderful life I had this poor man has gone through more shit than ANYONE EVER DESERVES!!
