House set to vote to reauthorize surveillance law after striking deal on reforms

Washington — The House is set to vote to reauthorize the Foreign Intelligence Surveillance Act (FISA) on Wednesday after reaching a bipartisan deal that includes several reforms just days before the measure is set to expire.

...The White House has not said whether the president would sign the bill as currently written, but a senior Justice Department official told CBS News on Tuesday that the administration is "pleased with the direction that we're headed."

The deal reached by House leaders would require officers overseeing FISA applications to certify that the Justice Department has been fully informed of any issues with the accuracy of the application, and require that agencies submitting applications appoint officers to ensure the applications are compliant with the law.

The bill also includes measures to assuage concerns by Democrats and libertarians worried about government overreach in surveilling of American citizens, such as ending the National Security Agency's to collect call detail records. It also includes measures to increase transparency, requiring the Justice Department to publish reports explaining its positions on how information is derived for FISA applications.

Trump caved on FISA. For what reasons or considerations we do not know but he seems willing to put it behind him otherwise he would have gone ahead and released the FISA docs. I hate to say it but I think he played us on that one. One year since he said he would release them — and nothing.

You can’t stop something if you’re unwilling to even expose it.

Before long most people in this country will view the Constitution as old school. They like the idea of governing (i.e., ruling) on the fly. It won’t work, of course, but we’ll have to suffer through a lot of national chaos, disruption and pain to eventually find that out.

I hate to say it but profound demographic and cultural changes have changed this once great country in deeply fundamental ways.

Already there. And the penalties are stiff - mostly 10 years PER OCCURRENCE.

Laws don't mean anything when they are weaponized against the people they were intended to serve.

Now the weaponizers need to pay. At 10 years per occurrence, its life in prison for most. Gonna be a lot of canaries looking to sing in exchange for saying out of the cage

As I recall he in effect gave Barr permission to release the documents, and left the decision up to the AG.

Well, in life timing is everything.

Nobody does timing and choreography like President Trump.

FISA renewal fight hits just about the same time Durham indictments, Gen Flynn disclosures, Burisma/Ukraine, Democrat embezzlement and laundering of Foreign Aid money a few other smelly shoes finally drop.

All just in time to gel right before the 2020 election - which will be thoughtfully monitored by independent certification agencies. Just to make sure the Russians stay the heck away, dontcha know. Sure the Democrats are gonna be thrilled and relieved at that one

None of the people in any part of the federal government gives more than lip service to privacy and other constitutional rights, limited government, etc.

"The deal" is to make sure they hold power, and the public does not.

You are correct but it sure looks like Trump was happy to leave us with the impression that the docs would be released. He told Sean Hannity:

"I do, I have plans to declassify and release. I have plans to absolutely release"

The problem with a veto is that it might force the cancellation of the existing FISA warrants on Ukrainian agent Joe Biden, Iranian agent John Kerry, former Soviet agent Bernie Sanders, agent-for-sale Hillary Clinton, etc.

I’m only half kidding about that.

I don’t disagree with you about “secret courts,” but here is the reality:

The FISA court does nothing except lend legal legitimacy to government surveillance that is already being done extensively anyway.

Read that again and remember it. Your government already conducts extensive surveillance on all forms of communication. Edward Snowden and Wikileaks already demonstrated this. All the FISA process does is give the surveillance the legal standing to be used in some kind of legal process later.

No, I got the point but just think you’re getting way ahead of things. I don’t see the “FISA fight” happening for a couple of reasons. We have no idea where Durham is at right now, the GOP senate is not inclined to want to get to the bottom of then matter, and it may well be an unproductive distraction in an election year (Trump needs to appeal to more than just conservativesw to win).

I actually sympathize with your view but am just not as certain about it happening as you are. Reasonable minds can, and often do, differ.
