Cibola County, New Mexico Sheriff Tony Mace says he and other sheriffs from around the state are meeting with attorneys this week as they get ready to file suit over the states new red flag law, signed last week by Gov. Michelle Lujan Grisham.
During the signing ceremony, Grisham said that sheriffs who werent prepared to enforce the new law should resign, but Sheriff Mace and other sheriffs are taking the matter to court instead. Mace tells me that the sheriffs will be holding meetings with several different attorneys over the next few weeks to discuss litigation strategies before filing suit to block the law from taking effect.
Mace believes the new law infringes on the rights of residents in New Mexico, and not just their right to keep and bear arms. He says the law establishes a bizarre civil search warrant process that violates the Fourth Amendment, and the seizure of firearms of those whove not been accused of a crime, much less convicted of one, is also a violation of the Fifth Amendments taking clause.

It will likely take aggressive freedom loving Western patriots to blaze the litigation trail on bringing to task liberal tyrants who believe they are free to infringe on American’s 2nd Amendment rights or any Constitutional right for that matter. 42 U.S.C. 1983 and 1985 is coming soon to sober up the tyrants.

My LE friends here in New Mexico tell me that what has them REALLY hacked off is the officer’s liability.
Let’s say that my neighbor bugs me. He has an NRA and a Trump sticker on his pickup. He plays country music and I have even seen him wearing a MAGA hat. I feel threatened.
I call the local police and make a complaint. The officer is then supposed to assess the situation and decide whether or not this should go before the judge. If he takes it to the judge it will be rubber stamped based on the officer’s professional assessment. If the officer decides to not take it to the judge - and the Trump lover later shoots someone - the OFFICER can be held legally liable.
So basically, to cover their a$$, the officers HAVE to take every complaint to the judge and the law instructs the judges to comply with the “professional judgement” of the law enforcement officer.
It is an untenable situation.

Here is the thing. I do not want this SC anywhere near a 2A challenge. We must flip at least one rat SC Justice probably two. The smart move is to endure these 2A encroachments in the meantime. We will lose the 2A for a generation if we let Roberts get the chance to side with the rats.

This is the second time Gov. Michelle Lujan-Grisham has threatened the sheriffs. Her administration is also investigating the Cowboys for Trump, claiming they didn’t register as a political organization.
Biden WILL start a civil war GOD forbid he wins.
Wonder how fast some black-robed tyrant will say they have no standing.
Maybe have several people call in on all of Gov. Michelle Grisham’s security team members and have the Sheriff’s confiscate all of their weapons.
How exactly does a governor threaten local elected officials?
She says sheriffs not enforcing Red Flag should resign. She can’t fire anybody. She can mess with their budgets but that’s about it.
In other words, the Gov needs majority support in the state assembly like any other legislation.
Siccing state police on a recalcitrant sheriff is bad optics and could touch off a shootout.
Good for them! That might even better than just telling her to go to hell and ignoring it, like they did the last two unconstitutional firearms edicts from Santa Fe.
