Debate is Over Concerning This Part of the Second Amendment?

The Left has long lost this debate, but they keep trying to relitigate it on the campaign stump. The Second Amendment grants the individual right to keep and bear arms. That was the landmark D.C. vs. Heller decision, though it applied only to federal enclaves. The McDonald v. Chicago decision extended this right to the states proper. But the Left is obsessed with the militia portion of the amendment: “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed”

The Atlantic has a good piece about this whole debate, including an analysis of the opinions from the late Justices Antonin Scalia and John Paul Stevens on Heller. The publication explained that they used two databases Corpus of the Founding Era American English (COFEA) which has 140 million words from documents between 1760-1799 and Corpus of Early Modern English, a massive text bank based on one-billion words British English from 1475 and 1800, to analyze their opinions. To no one’s surprise, Scalia’s majority opinion was more grounded in historical fact than Stevens, though both had inaccuracies. Still, even in the afterlife, Scalia is still right for the most part (via The Atlantic):

The signage on my local mall prohibiting firearms is an unconstitutional infringement.

The owners and management can establish whatever rules they want, such as banning teenagers after a certain time. I really, truly don't mean to sound like an @$$, but that's the same logic the communists used to force the bakery to make a wedding cake for a gay wedding. If the government can (try to) force a bakery to make a product, or an establishment to allow something on its grounds, what else can they do?

The purpose of the second amendment is to prevent tyranny. Not shoot Bambi, target practice, or have fun at a gun range. And tyrants can be from outside our borders,,,or inside.

Now explain how in that context why we should ever infringe on that purpose.

What the Left fails to realize is that a undocumented immigrant is an illegal immigrant.

Oh, I'd say the Left knows full well what the difference is between "militia's" & undocumented immigrant's. The real question is, do you know, or can you tell: when your being played for a fool.

The Left is very happy that school's don't exist anymore, just government re-education camps. Soon their be able to sell the idea, that hey it's the second amendment, no harm, no foul if we just toss it. /s

They can be liable in a wrongful death action if I comply with the sign and the jihadist ignores it. My wife is under orders to fund her widowhood by just such an action should such a thing occur.

It doesn’t state “the right of the militia”, it states “the right of the people”. Arguing that you have to be part of a militia to exercise the right to keep and bear arms is asinine, the people have that right, not the militia.

The first part of the amendment recognizes the need for and desirability of a citizen militia. The second part forbids government interfering with the right to own or carry weapons. Nothing there limits the right to militiamen, or forces militia service upon any citizen.

Anyone can sue anyone else for $200 in fed court. Winning by proving culpable negligence etc is another.... But I won't argue with you 😉
