NEW YORK (AP) — The Trump administration can withhold millions of dollars in law enforcement grants to force states to cooperate with U.S. immigration enforcement, a federal appeals court in New York ruled Wednesday in a decision that conflicted with three other federal appeals courts.

The decision by the three judge panel of the 2nd U.S. Circuit Court of Appeals [Ralph Winter/Reagan, José Cabranes/Clinton and Reena Raggi/Dubya] overturned a lower court’s decision [0bama judge Edgardo Ramos, SD-New York] ordering the administration to release funding to New York City and 7 states — New York, Connecticut, New Jersey, Washington, Massachusetts, Virginia and Rhode Island.

In the last 2 years, federal appeals courts in Chicago [Seventh Circuit], Philadelphia [Third Circuit] and San Francisco [Ninth Circuit] have ruled against the Trump administration by upholding lower-court injunctions placed on the enforcement of some or all of the challenged conditions.

It is to laugh. Reena Raggi writes the decision for our side.

This sets up a Supreme Court fight.

Elected officials should be civilly and criminally liable for any act committed by an illegal that has been apprehended and released after receiving an Ice hold request.

This will end this crap overnight.

Not true. People back in the 1930s still understood the federal government had no legal authority to do such a thing without passing a constitutional amendment. So all they did back then was make it illegal to sell marijuana without a proper tax stamp, and then simply refused to give anyone the tax stamp.

It wasn’t until the 70s that selling marijuana actually became illegal in and of itself, rather than a ginned up tax violation.

If I recall correctly, didn’t Bill Clinton withhold Highway funds to States that didn’t accept some Federal requirement? Was it seat belt laws or something like that?

in the mean time, this court decision IS the law in those seven states if/until the losers appeal to SCOTUS *AND* the appeals court to issue a stay of their own decision (unlikely) or get SCOTUS to issue an emergency stay (even more unlikely) ...

Withhold the money. That’s fine by me.

Have some b.lls at the fed level and do what you’re supposed to.

Its a Disgrace that cuomo and newsome make the Fed Govt look like b.tches afraid to act.

And while we’re at it, the 2nd amendment isn’t a STATE or LOCAL issue, it’s an AMENDMENT.

Get rolling on that too.

I’ll suffer the laws that the state and localities are allowed to pass.

But give a brother a break and at least enforce fed laws and amendments

Which time?
That despicable club was wielded several times, 55 MPH was one (RIP Nevada “Basic Speed Law” freedom), seat-belts another as I recall.
More recently I think it was swung to enforce minimum legal drinking age, age of consent?
It’s a “Go-To” club for enforceing Fed. demands of states to adhere to their desired policies.

In fact, maybe Trump should just swing that bat against the sanctuary states/cities?
It’s certainly been used often enough to be an “Established” process.

Excellent but it also says that any future dem President can ruin everything and hand this country over to foreigners; legal and illegal.

This country is so close to being lost to the left forever unless we fight hard forever just like with the gun-control freaks. They never give up so we always have to fight them. I’d like to see all gun-grabbers deported forever. That would make more sense.
