A U.S. Immigration and Customs Enforcement agent shot a man in the face who tried to intervene in a deportation arrest in Brooklyn Thursday morning.
It happened on 12th Street in the Gravesend section just before 8:15 a.m.
Authorities say the on-duty ICE agent fired his weapon while trying to serve a deportation order to Gaspar Avendano Hernandez.
As the officers attempted to detain Avendano Hernandez, they apparently got into a scuffle with his girlfriend's son, Eric Cruz.
The agent fired his gun, hitting the 26-year-old Cruz in the face.
He suffered non-life threatening injuries and was taken to Maimonides Hospital.
"He resisted because they didn't show him no papers, like 'Oh I'm the police,' no badge, no nothing, no warrant, no nothing," Diaz' brother, Kevin Yanez Cruz, said. "They just tackled him, and that's why he reacted the way he reacted. He didn't say, 'Get down,' he didn't say nothing. And he didn't have nothing, my brother, he didn't have no weapons in his hands, nothing. The minute they're tackling him, they get up to the door step, I'm here, my brother is here, he thought I was going to get involved, and he pointed the gun at my brother and didn't even hesitate and pulled the trigger."
Avendano Hernandez was hit with a Taser and was taken into custody. He was also taken to the hospital.

"Avendano Hernandez was stopped by the NYPD for driving with a forged Connecticut license plate earlier this week and he has a prior domestic violence history, but no arrests since 2016."
Well, he hadn't been arrest since 2016 so why should the police break his perfect record?
“He suffered non-life threatening injuries..”
What were they using...cork guns?
Maybe young Eric will not get into the middle of an arrest next time.
“The agent fired his gun, hitting the 26-year-old Cruz in the face.”
The fight ends when someone gets shot in the face.
“”He resisted because they didn’t show him no papers, like ‘Oh I’m the police,’ no badge, no nothing, no warrant, no nothing,” Diaz’ brother, Kevin Yanez Cruz, said. “
Well for starters asshole, if your city wasn’t an illegal-alien sanctuary city, ICE wouldnt have to present themselves like cops..
This is what happens when we don’t just deport the entire families all at once.
“What were they using...cork guns”?
Are you serious?
Don’t mess with I.C.E.
I hope the agent gets the Dick Cheney award for marksmanship at the next staff meeting
So they didn’t have to call Winston Wolf?
Eric can spend his days in jail thinking about what went wrong. What I hoped to see were some being on the next flight back to where ever they came from.
And they didn’t need that storage sign.
I suspect the officer’s TAZER was used on Kid AND Avendano Hernandez both so no one was shot with a firearm.
From another much better article:
Officers from ICEs Enforcement and Removal Operations team who are in charge of arresting and deporting illegal immigrants were in the process of serving a deportation order against Gaspar Avendano-Hernandez on West 12th Street near Highlawn Avenue in Gravesend when an associate of the deportee physically attacked the arresting officers, according to an ICE spokeswoman and law enforcement sources.
In the midst of the scuffle, the officers service weapon went off, sending a bullet through 26-year-old Erick Diazs hand that then ricocheted into his face, according to sources and Diazs brother, Kevin Yanez Cruz.
An ICE source told The Post that Diaz had reached for the officers gun, which is why he was shot.
