Many questions remain regarding how the Senate impeachment trial of President Trump will be conducted. Among the points of contention is whether or not witnesses should be called. Sen. Dick Durbin, D-Ill., joins Lisa Desjardins to discuss why he believes you cant have a trial without witnesses and evidence and how its no surprise that most Americans are not following impeachment closely.

Thank you, Senator, for joining us.
As you just heard, I asked Senator Barrasso, why not plan on calling witnesses now?
I want to ask you the reverse question. Why should you plan on that now? Why not wait to see what happens in opening arguments?
Sen. Richard Durbin, D-Ill.:
I respect John Barrasso. And I have to tell you, I respect the have to give a healthy respect and say that I disagree with him when it comes to witnesses.
He said at one point, if they wanted to call the witnesses, they could have called him in the House. No, John, the second count of the impeachment is the refusal of the president to cooperate when it came to discovery of witnesses and documents in the House of Representatives.
So there was no opportunity to call Mick Mulvaney, the president's chief of staff, by the House members who put together the articles of impeachment.
Why do I think witnesses would be appropriate? Because I spent most of my life before Congress as a trial lawyer. You can't have a trial without witnesses and evidence. You can have a cover-up without witnesses, but you can't have a trial.
And I don't think we ought to rule out the possibility that witnesses will get us closer to the truth, whatever that may be.

It's amazing how his parents already knew at birth what he was going to turn out to be.
We hear ya ‘dick’.
The lies continue.
The proper way to get access to those witnesses was to go through the courts. It’s not a big deal. It’s just a legal proceeding. But the Democrats in the House had to rush the whole thing. They couldn’t be bothered with judges and courts, so they abandoned those potential witnesses and just went forward with what they had — which was nothing.
The Senate should vote based on what the House has provided. Which, again, is nothing.
Dont you just love how these assholes always flip the problem.
It was the democrats who refused our witnesses.
Democrats could have waited to call those witnesses in the House! No one stopped them.
No impeachment ever fed a hungry child.
Should, but won't. Mark my words, the impeachment circus will continue in the Senate. A good number of the GOP in the Senate have no fear about removing this POTUS.
Clapper, Comey, Brennan, whistleblower/leaker Eric Ciaramella, Joe Biden (because he's on tape bragging about quid pro quo)....
Proceeds from impeachment pens go to the DNC.
I wonder what percentage of used car salesmen and ambulance chasing lawyers are democrats. Durban reminds me of those slick tongued lying scum.
The President wasnt impeached in the US House of Representatives. He was railroaded by a democrat mob in DC.
And add Adam Schiff who orchestrated the entire affair, i.e., the Ukranian hoax.
Evidence? Did the Chief House Moron get the elected nitwits to vote to impeach a president without evidence?
STOP OVERTHINKING THIS GOP!The average American couldn’t care less about this. Just end it. Dismiss and let them whine all they want! No one CARES.
The jury isn’t supposed to do the investigating or the prosecuting.
So, DICK, if the Senate trial needs witnesses that were not heard from in the House, then what evidence did the House use to issue their Articles of Impeachment?
Trump needs to turn the tables here and put the Dims on trial. Discover what is truly behind this coup.
Why? The Dems believed that they already had enough evidence to impeach the President. The evidence has already been presented. Its time to take out the trash.
You are sadly correct. They aren't afraid of Trump or the citizenry. They have long ago decided they are our rulers, not our servants. That must change or the American experiment will die.
