An Arizona woman was told last month that she must remove the Trump 2020 flag that currently flies above her property.
According to Prescott Valley officials, homeowner Tawney Baccellia was in violation of a city ordinance that prohibits the flying of political flags any more than two months before, or one month after, an election.
The ordinance also requires that political flags not be flown below an American flag.

Luckily for the homeowner, Prescott Valley Mayor Kell Palguta is “in her corner” and has already begun drafting a new ordinance to rectify the situation.
And that legislation cannot come fast enough for Baccellia, who reportedly has no intention to take the flag down any time soon — despite the fact that amendments to the ordinance may not be cleared by the city council until February.
“Shes demonstrating her first amendment right,” Palguta said. “She has every right to, and who are we to tell her no?”
Having taken office nearly a year ago, according to the city’s website, Palguta told KSAZ-TV this is simply a problem of outdated city codes.

OR maybe, just maybe, they tweak it to fit their needs is a better term.

There are a lot of towns in the US. Many really are governed by guys that just don’t think about the constitution much when they pass laws. It takes someone suing to undo them.
Another liberal trick that will fail in court.
“The Rainbow” is a political flag. Tell the alphabet people they can’t fly it all year, in June etc. if it is 2 months outside of an election.

the US Constitution, in its entirety, places limitations on the Federal government in its governance; this website, on the other hand, champions concepts such as state’a rights, and by extension, no doubt, county and municipal rights, and their governments operation free of the federal tentacle...
There is plenty of prior jurisprudence stating that such laws are a clear violation of the First Amendment.
Right now, there are two such flags flying on my street.
If it had been my property, I would be tempted to take down the flags, and instead run the hammer and sickle up the pole for a day or two, just to see if they’d complain about THAT. Bet you a shiny nickel that they would be perfectly OK with that. Then, if they didn’t complain, I’d run up the ISIS flag for another day or two and see what happened. Bet they wouldn’t find that one offensive, either. But G-d help you if you ran up the stars and bars. (rolls eyes).
The Nave was coming later that day to review our program. They would not been amused if they saw it the way it was. ;o)
Im on my boat in a marina in Ventura, Ca. Believe it or not there are Trump 2020 flags flying from boats all over the marina.
This City Ordinance will never survive court challenge, sounds like something the ACLJ may want to take up... or at least assist this woman in.
Now I believe speech is speech and action is action and the Supreme Court erred back in the 70s or 60s when it decided actions are speech as well..
However if action is considered speech then there is no way this ordinance can survive a court challenge.
Starting after/with Ohio didn’t every subsequent territory awarded Statehood, have to agree to the U.S. constitution as part of its own State Constitution? The Bill of Rights is not superseded by local ordinance right?
That’s a danger though for sure, and when leftists pass laws that violate the Constitution, no matter how small, if it’s not resisted, this kind of thing then becomes precedent.
