House, Senate stuck in impeachment limbo as Pelosi keeps hold of articles (IMPEACHMENT HELD HOSTAGE - DAY 17)
Fox News ^ | 1/03/20 | Chad Pergram

**SNIP**

It’s possible that Pelosi could still send the articles over to the Senate. McConnell and Senate Minority Leader Chuck Schumer, D-N.Y., could still forge a pact dictating the contours of a Senate trial. That’s what happened in 1999 when Senate Majority Leader Trent Lott, R-Miss., and Senate Minority Leader Tom Daschle, D-S.D., reached an agreement for President Clinton’s impeachment trial. But it’s tough to see how McConnell and Schumer can reach an accord signed off on by all 100 senators the way Lott and Daschle did two decades ago. And why would McConnell even entertain much of a conversation with Schumer when the Senate lacks the articles?

There has been talk that McConnell could just conduct a trial without the articles. McConnell conceded Friday that he can’t just ask Supreme Court Chief Justice John Roberts to walk across the street to the Capitol and start the trial. House Democrats would argue such a move is out of bounds if it still possesses the articles. If the Senate were to conduct some sort of impeachment tribunal without the articles, then the body would truly have entered unprecedented, parliamentary and perhaps extra-Constitutional territory The Senate has 25 rules which apply to an impeachment trial. McConnell can’t suddenly impose a trial on the Senate as dictated by those 25 rules without the agreement of all 100 senators. The Senate conducts much of its business via “unanimous consent.” If all 100 senators agree, as with the Lott/Daschle pact of 1999, then the Senate can do anything with a trial. But all it takes is one objection. And one could imagine there would be many objections.

Will there be a trial? Will there be witnesses? When does it start?

We don’t know much more than we did a few weeks ago.

With a very partisan vote, RATS passed articles of criminal charges against the President of the United States. One person is saying that the vote will not be recognized. A veto. Democratics must be really torqued off.

"McConnell can’t suddenly impose a trial on the Senate as dictated by those 25 rules without the agreement of all 100 senators."

Pergram is an arrogant ignoramus. Yes, if a Senator asks for "unanimous consent", any one Senator can say no, but that's not 100 to 1 veto power. If there is one objection, a vote of 51 Senators can overrule it. All McConnell needs is 51 Senators to approve, and he can have any rules and rule changes he wishes.

Legal expert Dershowitz says the Senate can hold a trial
without Pelosi info. Constitution says once a POTUS is impeached the Senate can start calling witnesses, get document.

Start the openning arguments and then let Trump finally have his right to defend himself honored.

Just dismiss the charges for failure to state grounds and to prosecute.

Josh Hawley has already introduced a resolution to that effect.

House Democrats lose their presumed leverage if impeachment is summarily dismissed by the Senate.

<><> House Judiciary Committee (HJC) argued in the DC court of appeals to obtain Mueller grand jury info, and to compel ex-WH counsel Don McGahn's testimony.
<><> The House has a group of dozens of various DOJ and former Obama officials working on their behalf. That House network also has several currently employed DOJ, FBI, State Department and Intelligence Community officials feeding them information on current real-time events.
<><> The HJC are currently arguing the Mueller material and the McGahn testimony are needed for the impeachment trial of President Trump.
<><> if the HJC team wins the argument to the three member DC Appellate Court, the DOJ will likely file for a full ‘en banc’ review by the entire panel.
<><> If the HJC wins the ‘en banc’ argument the DOJ will likely appeal for an administrative stay by the USSC.
<><> if the HJC team loses, they will most likely not file an appeal and will quickly release the impeachment articles to the Senate.
<><> The impeachment articles are being withheld in an effort to bolster the DC appeals court argument. Lose the legal argument is of no consequence....he Dems just start leaking anyway.--SNIP--

ANALYSIS What is glaringly apparent here is that while Hillary was set to serve Obama’s third term (as the price for his support), her loss shows nothing has changed.

Obama is living out his third term......with as much access as he had before......and is wielding power thru the various Obama factotums still in govt, still loyal to him.

When he exited, the Chicagoan calculatedly parked himself and ValJar in DC close to the WH .......and took with him the WH computers with all the incriminating evidence of his criminality.

WHY DOES PELOSI DESPERATELY WANT MUELLER'S FULL DOSSIER:

The Mueller investigation was purposed to dig, legally, into every aspect of Donald Trump, his family, his friends, his finances, his companies, his legal holdings, his lawyers, his accountants, his history… all of it… and they did so under both Title-1 and Title-3 surveillance authority; the Mueller probe was a counterintelligence operation (and tasked to cover-up all Democrat wrongdoing).

President Trump: travel records, phone records, electronic files, electronic communications, emails, electronic records, family files, medical records, bank records, tax records,… THE WORKS … all with unlimited surveillance authority as granted by former Deputy Attorney General Rod Rosenstein and the useful status of an unlimited counterintelligence operation. Think about the scale of the material Weissmann and Mueller gained access to? Think about the scale of these Trump files?

=======================================

AND THIS It wasn’t just “wiretaps” Democrats gained from the fraudulent FISA, the scurrilous
Obama FBI requested and received full Title-1 surveillance authority of Trump including:
<><>wiretaps,
<><> electronic surveillance,
<><> the use of bugs and tracking devices,
<><> physical surveillance,
<><> electronic surveillance
<><> satellite geo-location surveillance
<><> and much more.

The FBI requested a type of surveillance directed at Trump that is generally reserved for tracking suspected terrorists.

Leaked revelations showed then-FBI lawyer Kevin Clinesmith manipulated evidence to attain a Title-1 FISA surveillance warrant against Trump principal Carter Page to conduct political espionage against the Trump campaign.

NOTE WELL: When Mr. Clinesmith manipulated evidence to attain the phony FISA warrant, he was working under the guidance of FBI supervisory agent Peter Strzok.-—snip——rest posted on FR

One little difference, Liz. You might have heard something of it in the last 48 hours.

No one is stuck but in their heads, enough khabuki, Senate should move on as if it never happened, and keep the true aspect of a witchhunt going, don’t even give them a soundbite.
just say we have nothing from the House to do, I guess they are happy with that, we are moving on..

The Senate is not “stuck”. Pelosi is the one who is “stuck”. She ginned up this impeachment fiasco; it’s her albatross.

Dismiss articles of impeachment before the trial begins. 51 votes will do it.

Congress returns to town on the 7th. Aunt Nancy will walk the papers down the hall to Mitch’s office, with 100 photogs clambering round her.

She will mumble and stumble a few words about fairness.
