At first glance, (from the “HEAD” line), one would agree all the comments, but we really don’t have all the info here.

Apparently, from this unusual (to say the least) pardon, there HAS TO BE more to the story.

Bevin must have believed that this was the wrong guy (DNA) or he just had a YUGE payday.

At first, I got this mixed up with another case where the prosecutors were over zealous and refused new DNA tests arbitrarily, and, knowing prosecutors can be real pieces of work, I dug a little:

Why is the state unable or unwilling to test the EXISTING DNA evidence?

If there is evidence the state hasn’t tested, I’d want to know why... until then then I’d have to go with the gov on this one no matter how heinous the crime because it puts the conviction into the reasonable doubt category.

The criminal justice system in this country is rotten to the core, from top to bottom. You are all aware of and do not like what you see at the top of the ladder — well it is EXACTLY the same on the rungs below. I think Gov. Beven probably looked at the case carefully and saw a lot of prosecutorial misconduct, and did the right thing.

I saw a story elsewhere on this topic. Apparently Bevin, who I am embarrassed to say was one of our guys, issued hundreds of pardons on his way out the door. Many of them were really dicey or, as in this case, just wrong. I have no problem with pardoning somebody who made a mistake 20 years ago that did not involve violence or sexual predation and who got their act together and did not re-offend. But some of these pardons are indefensible.
