Last Thursday, in a move that surprised everyone but perhaps shouldnt have come as a surprise at all, New York State Attorney General Tish James withdrew two counts of fraud against ExxonMobil during her closing arguments in the flimsy case she and her predecessor, Eric Schneiderman, spent the last half-decade pursuing against the energy giant.
Tellingly, AG James dismissed the two of her original fraud counts that were based on laws requiring demonstration of actual harm in order to obtain a positive judgment. Her suit claimed that ExxonMobils alleged fraud of keeping two separate estimates of the future costs of greenhouse gas emissions had cost investors in recent years. Yet, as the Wall Street Journals editorial board pointed out in an editorial titled Parody of a Climate Trial published on November 7, Not a single Exxon shareholder at trial claimed to have been deceived. A PricewaterhouseCoopers director who performed 13 years of audits for Exxon said he was not aware of any attempt to manipulate either cost.

New York’s anti carbon fuels, anti nuclear campaign will soon bring economic disruption, expensive unreliable electricity as well as political and social unrest to the entire Connecticut, NJ,NY area. The voters will then reap what they have sown.
Most likely this was a range of two numbers on potential future estimate costs to investors. Since it would be very difficult to determine an exact number, they most likely came up with a low and high number.

And Exxon/Mobil should have BANNED ALL SALES to Any State suing them over this religious zealotry a long time ago.
Nobody saw that one coming, uh uh, nobody.
No they won't. They'll just move to Texas or Florida or Georgia or NC, etc. and bring their voting patterns with them to ruin another state.
I remember them, and thinking it took real courage to fight back.
I cannot say if I saw the ads in the last 10 years. I just don't read much paper printed stuff anymore.
I believe the entire idea behind this suit was to get Exxon-Mobile to settle and make it go away. The Ohussein JD this this sort of thing regularly and used the settlement money to give away to their supporters.
I congratulate EM for taking a stand and fighting back. Perhaps others will learn from this.
I wish Exxon had the balls to counter-sue the State of New York and the Attorney Generals that represented it...
If we have a very, very cold winter this year in NYC don’t be surprised if that place doesn’t go to hell in a handbasket with their gas supplies.
They are increasing use daily but not allowing the pipelines to be built to increase the supply. Gas pressures in the city have been dropping steadily already, anyone guess what a furnace does when the pressure drops too low? Yep, it shuts down. All this because PA is fracking for their gas and NY refuses to buy that filthy fuel.
What’s it going to take? Someone’s grandparents freezing to death in their blankets this winter to make them understand? Naw, it’ll be the gas suppliers fault not the regulators. Just watch the finger pointing when, not if, it happens.
So can Exxon Mobil sue the state of New York for attorney fees and then give them to share holders as a special dividend?

He filed the case and dumb Democrat broad Tish James continued it on the theory Exxon-Mobil would settle out of court.
