Joseph Sinawa feels like he's fighting an uphill battle against the state of Florida. He's being forced to pay child support despite a DNA test proving he is not the biological father.
"I signed the birth certificate because at the time I believed I was the biological father," said Sinawa.
He says the child's mother is even okay with him not paying child support because she doesn't want anything to do with him, but the state is forcing the issue.
"She told the judge she just wants this to be done and over with, and so do I," he says.
On top of it all, Sinawa says he struggled when he learned the child was not his.
"I was emotionally devastated," he said.
It all started when he went to the Saint Johns County courthouse last year in an effort to obtain visiting rights for the child, so judge ordered a DNA test to prove his paternity.
The results were shocking. He learned wasnt the father after all.
"At the time it had been taking $83 out of my paycheck, more than 1/3 of my pay," he says. "When I thought I was the father I didnt have a problem with it."
It was the Florida Department of Revenue that appealed the decision by the judge. The reversal meant Sinawa had to continue paying child support.
St. Augustine Attorney Brandon Beardsley has been practicing family law for more than 16 years. He was surprised by the Department of Revenue's decision to file an appeal
"Ive never seen this happen before," said Beardsley.
He says the state appealed the judges decision because it didnt feel like Sinawa "jumped through the right hoops" to properly disestablish paternity.
"It was a waste of Florida taxpayer resources to appeal a decision when the end result is going to be the same," said Beardsley.
Beardsley said eventually Sinawa should be let off the hook, but hes going to lose more money first.
"Youre just making a father pay child support every month now for an extended period of time, which he should not be paying, until he follows these procedures," he said. "The problem with the department of revenue is that the state is their client, not the mom."
Sinawa says hes currently representing himself since hes strapped for money and cautiously awaiting the next court date. He is working to once again disestablish his paternity from the child.
This is very wrong.
Not the first time that has happened. If you’re the father and want the child but the mother does not, you have no rights.
If you are the father and don’t want the child but the mother does, you have no right, you pay.
If you are not the father but the mother names you as the father, then you pay.
Men have no rights, women hold all of the cards.

This is total insanity.
The state gets from the fed $1 for every $3 of collected child support. Thats why so many ppl are put onto the system where the state manages the child support and also the $ amounts are right up to the maximum allowed by the feds. It is a racket.

Correct but doutful appeal matters state just mrssing with him
Florida, like most states, never changed the common law rule despite the development of technology for rapid and definitive paternity tests. The reason is said to be that litigation over the parentage and legitimacy of a child can be so extraordinarily destructive that it is thought better as a matter of public policy to not permit it.
The only thing a man gets out of being married is almost iron-clad paternity. The man and the State have both been victimized by his ex-wife, but the State is going to punish her other victim, and reward her by keeping him ponying up the cash. Yay socialism...
The moral of the story is that if a man doesn’t have sex with a woman, he’ll know he isn’t the father of her child.
Not surprised at all. Wrong, yes. Ridiculous, yes. Typical, oh yes. The domestic violence laws are as screwed up or moreso. A neighbor can call the cops about hearing a married couple arguing (as they do). By law (atleast in Washington state), one of them HAS to go to jail even if they have calmed down by the time the cop gets there. Now here’s the kicker, the judge can and will make a no contact order even if the couple does not want one. The the man (usually) cannot go into his own house unless arranging a police escort.
The rule makes less sense today, but judges seem to cling to it all the more firmly as a way to avert the damage inflicted on children by a paternity contest. Family law judges just hate the damage that domestic relations litigation so often does to children.
He’s not the first and he won’t be the last. If the man shows any interest at all in being the parent, biological or not, the “family courts” grab the man’s wallet and don’t let go for 18+ years.
