This is simply a defense tactic and nothing else. Legally speaking, it adds a plausible yet improbably explanation; IE, no malice, just bad intel.
Of course, in actually, it defies credulity that anyone who works with intelligence as a living would ever take faulty intel and operate under it for so long, particularly when it is being challenged so heavy. No one would double down on it like he had under those conditions unless they were in fact using the ‘intel’ for a purpose.
