Finally – John Ratcliffe Explains Why Pelosi’s “Impeachment Inquiry” is Being Run From House Intel

Good grief it’s taking the republicans f.o.r.e.v.e.r to explain to the American electorate what is going on behind the thoroughly corrupted political impeachment process. In this interview John Ratcliffe finally explains why the “official impeachment inquiry” is not being run by the House Judiciary Committee that holds impeachment jurisdiction.

Speaker Pelosi, with forethought and planning by the Lawfare Alliance, is intentionally using non-jurisdictional committees because she is manipulating the process. It’s the same reason why the House Intelligence, House Foreign Affairs and House Oversight committees cannot legally send out “Impeachment-based Subpoenas“; they have no impeachment jurisdiction. {Go Deep} and {Go Deep} to understand why.

The “impeachment” subpoenas’ are not technically subpoenas because the basis for the requests, impeachment, is not within the jurisdiction of either committee. So the committees are sending out demand letters, calling them subpoenas (media complies with the narrative), and hoping the electorate do not catch on to the scheme.

At some point, a federal judge is going to drag them in and just say....either you vote on impeachment and do official subpoenas.....or you halt this fake subpoena game right away.

It’ll be curious to see if the Ukraine shows up...does court action, and subpoenas Hunter Biden.

Trump has over 63 MILLION followers on Twitter. He needs to ceaselessly POUND this purposeful corruption of the process day by day along with WHY the loony left is doing it this rather than the right way.

Trump has more folks following him then the combined audiences of all the media and if he speaks the people will hear.

I disagree with Sundance on this one, and posted on his thread to explain why.

Sundance appears to be saying that if Judiciary issued these subpoenas they would be valid.

That also means they would be valid without a vote of the whole House.

My contention is that NO Committee has been delegated impeachment powers. The House has not exercised any impeachment power until the House votes to do so. The House could, with a vote, delegate the impeachment power (and its associated subpoena power) to one or more Committees.

Supporting my point of view, besides the “obvious” flaw that Judiciary can issue valid impeachment-related subpoenas w/o a House vote, is House Rules, which appears in a combination of three documents.

Standing Rules of the House, from the 114th Congress, form Committees and delegate jurisdiction. All of the delegated jurisdiction is for legislative and oversight functions. The string “impeach” (which appears in the word “impeachment”) does not appear in the Standing Rules. No Committee has impeachment jurisdiction under the Standing Rules.

There are also Rules passed by the House in the 115th and 116th (current) Congresses. Those modify subpoena issuing authority, etc. but do not modify any Committee jurisdiction. The string “impeach” does not appear in either of these.

The Impeachment power stands separate from the power to legislate. The legislation power is in Article I, section 1 of the US Constitution. The House power to impeach is in Article I, Section 2. It, acting pursuant to its power to impeach, is totally separate from its power to legislate. The House holds this power, and has not delegated it to any Committee. It has to pass a House Resolution to delegate its impeachment investigation power.

It makes sense that this delegation is not made as a “standing” matter, and indeed, historically, Judiciary is not the only Committee that has undertaken impeachment investigation. It could very well happen that the officer to be impeached is in the wheelhouse of some other Committee. Yes, to Judiciary when the target is a judge - and maybe when the target is president. But the target is not always president or judge.

I feel that Barr should get involved and reign in the absurd tactics that the Rats are performing. I understand the separation of powers but this crap is out of control. These Rats are acting like they’re running the country. McConnell should get his act together also. He probably feels that impeachment will die in the Senate but who knows with the squishy Repulsivcans? The President is doing a great job of fighting but the daily drumbeat is the Rats real plan. When you see how vicious the Rat Congress is it makes you realize what a wimp Ryano was.

Judges never act on their own. Somebody has to initiate action before a court.

Nadler is attempting to invoke House impeachment authority to get grand jury Rule 6(e) material. He took his case to a court to get a court order. He sort of had to, becuase Rule 6(e) material is court material in the first place.

Docket for Nadler Application for GJ/Mueller Material : Case 1:19-gj-00048

Jul 26: Nadler Application to Unseal Grand Jury / Mueller Report
DC District Court Case 1:19-gj-00048 | Judge Beryl Howell

Sep 13: DOJ Response (Objection) to Application to Unseal
Oct 03: Rep. Collins Amicus Brief - Not an Impeachment Inquiry

Sep 17, 2019

MINUTE ORDER (paperless) DIRECTING the parties, at 10:00 AM on Tuesday, October 8, 2019, to appear for a hearing before Chief Judge Beryl A. Howell in Courtroom 22A. Signed by Chief Judge Beryl A. Howell on September 17, 2019.

Loser will certainly appeal.

I think somebody should appeal to the Supreme Court on Constitutional grounds. There is no way it is legal for a power crazed political enemy to circumvent the Constitutional guarantees ... everything from due process onwards ... by inventing and declaring her own extra-legal proceedings that will have legal effect. Nothing gives House Procedures the right to override the Constitutional guarantees.

This must be stopped.

It's not his job to keep the House from running a Chinese Fire Drill. He has no power to stop them from acting like ninnies.

The WH has been ignoring the House fake subpoenas up to this point. Today the WH will inform the House that it will ignore impeachment-related demands until the House invokes its impeachment authority and power.

Interesting to me is that only Andy McCarthy and Victoria Toensing are "on the ball" telling whoever will listen that the House is conflating legislation power with impeachment power.

The press is, as usual, deliberately misinforming the public. I will bet 100% of classrooms are also "ignorant" on this very basic constitutional principle.

FWIW, House Committee don't appear in the Constitution. The authority for them is found in House Rules.

Where in House Rules is impeachment authority delegated? Nowhere. See the House Rules. Nancy the expert is playing everybody for the damn fools they are.

“I think I heard on the radio over night that the FISA crap will finally be exposed on Friday.”

Friday, November 6, 2020. The RATs and RINOs will hide the truth until after the election.

A reminder: “The Issue Is NEVER the issue” (not mine)
The Rats have a playbook and they’re going through it one by one. They will never stop. First they tried bimbo’s then they tried Russia, Russia,Russia, when that didn’t work they tried white supremacist/racist, when that didn’t stick (they haven’t given up on that one,and won’t ever)they pulled out this lawyer assisted “whistle-blower”, when this fails, as it will, they already have another lined up and ready to go. Stick by Trump and don’t be intimidated, we need to get out and campaign for him. There are plenty of people on the fence (go figure) that we need to convince to vote for him. Don’t let them shut us up or we are lost.

Good point—hopefully that appeal is what will happen—the Supreme Court should end this mess.

Then the Democrats can go back into anti Supreme Court hysteria mode—where they belong!
