Full title: Judicial Watch: Court Forces Release of Clinton WikiLeaks Discussion Email that Confirms State Department Knew About Her Email Account
'She guards it pretty closely'
(Washington, DC) – Judicial Watch announced today that the State Department provided a previously hidden email which shows that top State Department officials used and were aware of Hillary Clinton’s email account.
On December 24, 2010, Daniel Baer, an Obama State Department deputy assistant secretary of state, writes to Michael Posner, a then-assistant secretary of state about Clinton’s private email address:
Baer: “Be careful, you just gave the secretary’s personal email address to a bunch of folks …”
Posner answers: “Should I say don’t forward? Did not notice”
Baer responds: “Yeah-I just know that she guards it pretty closely”
Mr. Posner had forwarded Clinton’s email address, which was contained in an email sent to State Department senior leadership, about WikiLeaks.
It appears the State Department produced this email in 2016 in redacted form , blacking out Clinton’s personal email address and the discussion about Clinton’s wanting to keep her email address closely guarded.
Judicial Watch sought the email after a former top Freedom of Information Act (FOIA) State Department official testified to Judicial Watch about reviewing it between late 2013 and early 2014.
The testimony and the email production comes in discovery granted to Judicial Watch on the Clinton email issue in a FOIA lawsuit ( Judicial Watch v. U.S. Department of State (No. 1:14-cv-01242)). Clinton also faces potential questioning under oath in this lawsuit.
Despite a recent court order requiring production of the email, the DOJ and State Departments only produced it 10 days ago after Judicial Watch threatened to seek a court order to compel its production.
“Judicial Watch just caught the State Department and DOJ red-handed in another email cover-up – they all knew about the Clinton email account but covered up the smoking-gun email showing this guilty knowledge for years,” stated Judicial Watch President Tom Fitton.
The scope of court-ordered discovery that produces this email find includes: whether Secretary Clinton used private email in an effort to evade the Freedom of Information Act (FOIA); whether the State Department’s attempt to settle this FOIA case in 2014 and 2015 amounted to bad faith; and whether the State Department has adequately searched for records responsive to Judicial Watch’s FOIA request.
During a recent hearing , Judge Lamberth specifically raised concerns about a Clinton email cache , carterheavyindustries@gmail.com, discussed in a letter to Senator Charles Grassley (R-IA) and wants Judicial Watch to “ shake this tree ” on this issue.
Judge Lamberth also criticized the State Department’s handling and production of Clinton’s emails in this case stating, “There is no FOIA [Freedom of Information Act] exemption for political expedience, nor is there one for bureaucratic incompetence.”
The court rejected DOJ and State efforts to derail further Judicial Watch discovery. Judge Lamberth called their arguments “preposterous” and cited a prior Judicial Watch FOIA case in which he ordered U.S. Marshals to seize records from a Clinton administration official.
Judge Lamberth detailed how the State Department “spent three months from November 2014 trying to make this case disappear,” and that after discovering the State Department’s actions and omissions, “Now we know more, but we have even more questions than answers. So I won’t hold it against Judicial Watch for expanding their initial discovery request now.”
Judge Lamberth stated his goal was to restore the public’s faith in their government, which may have been damaged because of the Clinton email investigation.
The court granted Judicial Watch seven additional depositions, three interrogatories and four document requests related to former Secretary of State Hillary Clinton’s use of a private email server. Hillary Clinton and her former top aide and current lawyer Cheryl Mills were given 30 days to oppose being deposed by Judicial Watch.
On December 6, 2018, Judge Lamberth ordered Obama administration senior State Department officials, lawyers and Clinton aides to be deposed or answer written questions under oath. The court ruled that the Clinton email system was “one of the gravest modern offenses to government transparency.”
This Judicial Watch FOIA lawsuit led directly to the disclosure of the Clinton email system in 2015.

In reviewing what the agreements uncovered, keep in mind that Cheryl Mills was Secretary Clinton's Chief of Staff at the State Department and then bizarrely, she subsequently served as Clinton’s attorney, representing her in the email scandal. Heather Samuelson worked on Hillary Clinton's 2008 campaign, and then became a Senior Advisor to her at the State Department, as well as the White House liaison. Somehow, she also became one of Clinton's personal attorneys during the email scandal.
The immunity agreements issued by the government, were crafted so that the agencies could extract information from the parties, despite the fact that this is not necessary because DOJ has the power to require that the information be turned over. Clinton kept classified emails on a private server in violation of Federal law, and the immunity agreements reveal that both Cheryl Mills and Heather Samuelson were actively involved in the cover-up of these emails as well as in the destruction of evidence. According to Jordon Sekulow, Executive Director of the ACLJ, it is extremely unusual for someone involved in a criminal cover up, who needs an immunity deal to ensure the evasion of jail time, later becomes the attorney representing the other potential criminal or co-conspirator. 2012 Email Shows Hillary Aide Cheryl Mills sent info marked confidential to Clinton Foundation

A key aide of Hillary Clinton emailed classified information about the government in Congo to a staffer at the Clinton Foundation in 2012, according to a copy of the correspondence obtained by the Washington Free Beacon.
Cheryl Mills, Clinton/s chief of staff at the State Department, sent the email to the Clinton Foundation’s foreign policy director, Amitabh Desai, on July 12, 2012.
The message, which was originally obtained by the group Citizens United through a public records request, is partially redacted because it includes foreign government information that has been classified Confidential by the State Department......but was not marked classified by the State Department until this past summer.
Intelligence sources tell the Free Beacon that it would have been classified at the time Mills sent it because foreign government information is considered classified from inception.
The message could add to concerns from congressional and FBI investigators about whether former Secretary Clinton and her aides mishandled classified information while at the State Department.
About half of the forwarded message was redacted due to its classified nature before the State Department released it to Citizens United last month.
Although it is not clear what the redacted section includes, the State Department said in a court motion filed last week that it concerns both foreign government information and critical aspects of U.S. foreign relations, including U.S. foreign activities carried out by officials of the U.S. Government.
The State Department added that the disclosure of this information has the potential to damage and inject friction into our bilateral relationship with African countries whose cooperation is important to U.S. national security.
The Clinton Foundation and the State Department did not respond to request for comment about the email, or say whether Desai...a non-government employee who has worked at the foundation since 2007....would have been authorized to view Confidential information.

Hopefully sunlight is going to properly shake faith in government, not restore it. Faith in government is a fools posture anyway. The government is fundamentally dishonest. This is why the founders tried to keep it small, no standing army, very limited jurisdiction. It's grown way outside its boundary with the assistance of the federal judiciary,

I’ve said for years that the Clinton Foundation was a CIA front operation, set up for the purpose of laundering foreign money for weapons sales to rogue factions in countries where the U.S. wanted to take sides in civil wars without leaving a paper trail to the U.S. government.
Contrary to your delusion,
the Clinton server was used to shield Hillary’s Clinton Foundation self-appropriation activities.
