Here's Why Democrats Should Be Scared of a Supreme Court Vacancy in 2020

In the aftermath of the news that liberal Supreme Court Justice Ruth Bader Ginsburg has once again been treated for pancreatic cancer, talk of a potential vacancy on the court has once again heated up. While there will be disagreement over how to handle such a vacancy, it's clear that everyone knows a Supreme Court battle in 2020 will be brutal and contentious.

Chris Wallace, the host of Fox News Sunday, weighed in on Friday, "We all wish her a long, happy, healthy life. I will say this though, and again, there’s no reason not to think that she won’t be on the court the first Monday in October, but if she were forced to step down, this would make the Kavanaugh hearing, the Gorsuch hearing, Clarence Thomas, it would make it look like a tea party.”

Former Obama adviser David Axelrod warned Senate Majority Leader Mitch McConnell not to go through with filling a vacancy, should one occur:

If there is a SCOTUS vacancy next year and @senatemajldr carries through on his extraordinary promise to fill it-despite his own previous precedent in blocking Garland-it will tear this country apart.

If Ruth Bader Ginsburg were to retire, you can expect to be regularly reminded of Merrick Garland, Barack Obama's nominee to the Supreme Court following the death of Antonin Scalia. Garland was never given a hearing because Mitch McConnell was following The Biden Rule. In June of 1992, then-Senator Joe Biden, who was chairman of the Senate Judiciary Committee at the time, gave a speech on the Senate floor arguing that then-president George H.W. Bush shouldn't attempt to fill a vacancy to the Supreme Court in the middle of an election year.

If the GOP should delay nominating a Supreme Court Justic till after the election we would see a Democrat turnout that would set new records for sure....

The opposite would be true also ... installing RGB’s replacement before the election would suppress D votes.

Axeldoosh should worry more about Sudden Hemp Obstructive Pulmonary Disorder than "tearing the country apart".

He'll have a great view of the "tearing apart" from one of the DC cherry trees...

In this one sentence alone, he uses a negative three times.

The problem the Democrats have is that they PROMISED to stack the court if they win in 2020...so ALL OF THE RULES ARE OUT.

Also, it won’t be as easy as with Kavenaugh to make a spectacle. We have 53 Republican Senators now, not 51, and we have slightly less of a RINO problem with those 53. The confirmation of a well-qualified Justice will likely happen very, very, quickly.

Precedent shmecedent. It’s one citizen’s opinion. It is definitely not codified law. I am sure, if push comes to shove, that President Trump is fabulously suited to making sure all of America becomes aware of that fact.

I agree...The Rats won't be able to pull off another spectacle like they did with Justice Kavanaugh.

Exactly right.

On so many threads, I read fellow FReepers complain, often in despair, about Trump’s lack of attention to this or that issue.

I reply: Just because nothing is out in public, that doesn’t mean Trump isn’t making plans in secret.

Particularly, he absolutely HAS to know about the RATs vote fraud capabilities.

What I do notice is that Trump is tightening the screws on a lot of issues — particularly immigration and China. Timing is everything on a lot of these issues, so I expect some real “don’t fire until you see the whites of their eyes” action as the election draws closer.

We have 53 Republican Senators now, not 51...

Two or three of which are very vulnerable in the election, up to three of which could be vulnerable with the right opponent, and at least three who might vote against Trump just because he's Trump. Filling a seat between now and January 2021 is not a done deal.

I agree we could have better Senators and technically something might come up, but if they couldn’t stop Kavenaugh when we were at 51, they’re not stopping someone like Amy, and they won’t even be able to slow her down, unless they go full violence.
