Harvard professor crudely calls Trump a 'racist' who wants to 'reverse outcome of the Civil War'

Harvard law professor Laurence Tribe unleashed an unhinged attack on President Trump and his supporters Wednesday after the commander in chief said he was considering an executive action that would end the practice of "birthright citizenship."

"This fuxxxng racist wants to reverse the outcome of the Civil War," Tribe claimed. He was referring to the 14th Amendment, which is often cited by media figures as a Constitutional guarantee to citizenship for anyone – including children of illegal immigrants – born in the United States.

“In December 2016, Tribe and notable lawyers Lawrence Lessig and Andrew Dhuey established The Electors Trust under the aegis of EqualCitizens.US to provide pro bono legal counsel as well as a secure communications platform for those of the 538 members of the United States Electoral College who were considering a vote of conscience against Donald Trump in the presidential election.[30]

After the dismissal of James Comey in May 2017, Tribe wrote: “The time has come for Congress to launch an impeachment investigation of President Trump for obstruction of justice.” Tribe argued that Trump’s conduct rose to the level of “high crimes and misdemeanors” that are impeachable offenses under the Constitution.[31] He added: “It will require serious commitment to constitutional principle, and courageous willingness to put devotion to the national interest above self-interest and party loyalty, for a Congress of the president’s own party to initiate an impeachment inquiry.”[31]”

The easy way to view this is with a little hypothetical.

Let’s say Ihlan Omar, a naturalized citizen, was involved in an Islamic plot to blow up ICE offices and murder ICE agents. In the process she and her co-conspirators import an ISIS bomb maker. For once the FBI is on its toes and busts the plot and all the plotters. Omar and the other US citizens involved in the plot could and should be prosecuted for treason because they are US citizens and participated in a treasonous plot to wage war against the US. The ISIS individual, although he could be prosecuted for terrorism, couldn’t be prosecuted for treason because he’s not a US citizen and, hence, has no legal obligation of loyalty to the US.

IOW, “jurisdiction” has two components: 1) physical jurisdiction where anyone in the US has to obey its general laws and 2) allegiance jurisdiction that requires citizens to give the US their allegiance, including not committing treason. If both parts of the definition don’t apply to somebody, as in the case of the ISIS individual, he’s not “subject to the jurisdiction” of the US to the point where his kids that happen to be born here can be deemed US citizens.

There in fact is no support for birthright citizenship being extended to children of illegals.

In Wong Ark Kim, the Supreme Court stressed that the parents were legally in the United States, essentially the 19th century version of green card holders, and thus could be considered subject to the jurisdiction of the U.S.

In Elk v. Wilkins, however, the Court held that the Native American plaintiff could NOT be considered to be an American citizen although he was born in the U.S. Why? Because his parents were the citizens of an Indian Tribe, and thus were citizens of the tribe and not subject to the jurisdiction of the U.S. (American Indians were not granted U.S. citizenship until 1924.)

Ditto for every child of illegals here. But it will never be enforced, because it would force every person to be able to show that their parents were legally in the U.S., and the federal government is not going to make people do that.

It is clear that everything from sexism to racism to Russian collusion has not touched Trump. Now there is a full court press to label Trump as racist and the NYT (1619) and others are trying to say that racism is a crime that all should shun and that should disqualify anyone from elected office.

This is a last desperate attempt at getting rid of Trump.

Has anyone else noticed that President Trump is the only Republican who doesn’t bother to defend himself on this nonsense? After decades of employing thousands of workers, one can safely presume that if there was a scintilla of evidence to suggest that the President is racist, *someone* would have popped up with a video by now to reap the rich rewards. Where are they?

The fun question is, what will be the dems’ next desperation punch after they realize raaaaacccccccyyyyyssssst flopped again?
