The Fallacy of Red Flag Laws

Democrats are using the shootings in El Paso and Dayton to call for more gun control. Regrettably, Republican leaders are joining the call. From President Trump, to U.S. Senate Judiciary Chairman, Lindsey Graham (R-S.C.) to U.S. Senator Pat Toomey (R-Pa.), Republican leaders are calling for the enactment of so-called “Red Flag” laws. Sadly, our political leaders are quick to give up our constitutional rights just to look like they're doing something to prevent the next mass shooting. Yet, even with more gun control, the shootings will continue; but our constitutional rights will be gone.

In response to the latest shootings, the president declared, “We must make sure that those judged to pose a grave risk to public safety do not have access to firearms and that if they do, those firearms can be taken through rapid due process. That is why I have called for red flag laws...” Although these laws may be well-intentioned, they’ll be disastrous to our rights, subject to abuse, and ineffective in addressing the real problem.

Nevertheless, State Sen. Tom Killion and State Rep. Todd Stephens, both Republicans, have proposed our own Red Flag law. Through this bill, a law enforcement officer or “family or household member” can petition the court, without your knowledge, claiming you present an extreme risk of harm to yourself or others. The judge will review the petition, again, without your knowledge or involvement, and if he finds that you’re an extreme risk, he’ll issue an Interim Extreme Risk Order compelling you to relinquish your firearms and prohibiting you from possessing same.

Think the “No Fly List”. people show up on this list all the time who are totally innocent and are of no threat to the flying public. And how do these people find out they’re on this list? When they are processing through security at the airport.....

Classic "ratchet" politics -- things only move one way. Bit by bit the constitutional rights fade away, and meanwhile no actual problems are being solved.

I can see how judges will like Red Flag laws: more power for them over the people!

One way to fight this, if enacted, would be to report on every liberal you know who has a gun.....

Wrong. We are endowed by our Creator with rights, the U. S. constitution is NOT the granter, it is the guarantee.

Mitch the ‘Rat Bitch is saying “we have to do something.” Note that doesn’t include building a wall, stopping massive overspending, or ending Black on Black violence in the urban rat holes.

No, it is to strip Constitutional rights from the citizens.

Trump is on very, very thin ice. He EO’d bump stocks, “doesn’t like silencers,” and now favors Red Flag laws. This from the man who claims to “protect our precious Second Amendment.” We shall see.

The bill being proposed would give grants to states that implement Red Flag laws.

Are you still going to vote for Biden?

The use of “mental illness” as a disqualifier is the trap. You will be classified as “mentally ill” if you hold “dangerous ideas” such as being a Christian or objecting to GQBLT.

Must of the people in the Gulags were there because they were declared mentally ill for holding wrong ideas.

Florida has had the Baker Act since 1971. It involves the loss of freedom, but it hasn’t caused other rights to fade away.

I think I see a way out for Trump; IF one of the ‘red flags’ is proposed to be ‘queerness’, there may be an outcry from that community (or not) and grounds to ‘kill’ any legislation ...

Before they were banned, I remember FReepers calling bump stocks worthless toys. They aren’t a big loss, but if you still want one you can make one or you can buy a Hell fire trigger.

It is a shame about silencers, though. It would be great if they could be bought without paperwork or taxes.
