Lots of conservatives are understandably upset that the IG Horowitzs criminal referral of James Comey for leaking classified memos memorializing his conversations with President Trump is not being prosecuted by the Department of Justice. It eerily reminds us of James Comey exonerating Hillary Clinton for her prima facie violations of the Espionage Act because he could perceive no criminal intent (which is unnecessary for gross negligence to apply).
Weve been suckered before, so cynicism is warranted. Tucker Carlson opened his show last night making this point:

But there is more much more to the story this time. The case against Comey for leaking is weaker and less serious than his signing of the FISA warrant applications that corruptly cited the Steele Dossier, even though it was known to be unverified. IG Horowitz has a separate report coming on that, and US Attorney John Durham is reportedly working on prosecuting that.
Watch two very distinguished, high profile attorneys Joe di Genova and Alan Dershowitz -- discuss this with Laura Ingraham. And as you do, imagine to potential consequences of taking as the first case against Comey a prosecution that could well be lost. Once a prosecution fails, the calls to drop the political motivated persecution would be legion. I is important that the first case taken to a jury be rock-solid and serious.

Nunes explained the situation very well, on Tucker’s program last night. ALL the evidence they have accumulated against Comey is being handed over to John Durham, and there are, in addition to the leak in evidence crime, several other crimes around which they are building a case against him. I am, for now, willing to take a wait and see attitude, for now.
Barr is right....You dont want to start with a weaker, less egregious case. After all the classification was made post Comey leaking and there are mitigating factors involved which would make this conviction a bit iffy (should be no problem with starting a soft coup).
Sorry but this is a load of BS. Why do you ask? The FISA abuse is years old. If they can’t make a case in the six months Barr has been on the job, when will they? What is there to even question? You don’t need an OIG report to charge anyone, that’s silly.
Barr received dozens of criminal referrals from congress almost on the day he was appointed. NOT ONE person paid the price or was charged. A lot of the referral were provable on day one. Lying to Congress under oath and obstruction of a congressional inquiry among the few.

Comey already got his. A 7 figure book deal. Those book deals are the promise. After dropping the first case, the calls to drop the second as a "There's nothing there!" case will also be legion.
Maybe they haven't got enough to charge Comey for leaking, but there is no point in pretending this action will make subsequent charges any less vulnerable to Leftist political spin.
