Comey referred for prosecution, Barr declines

The Justice Department declined to prosecute former FBI Director James Comey following a criminal referral from the agency's independent watchdog, which concluded that Comey had leaked classified information and showed a lack of candor with investigators.

Inspector General Michael Horowitz reached out to prosecutors about one of the memos Comey leaked to a friend, which detailed a conversation he had with President Trump, after he was fired by President Trump in May 2017.

Although prosecutors found the watchdog's findings compelling, they decided against prosecution under classified information protection laws because of there being too much uncertainty surrounding Comey's intent, according to the Hill. A month after he was fired, Comey testified to Congress he had leaked his notes to a friend to give to the media, hoping that it would spark a special counsel investigation.

Hopefully, AG Barr is building a bigger case that will encompass these charges, but given the climate in DC, I don't personally hold out much hope.

If indited, he could be portrayed as a “victim” by the media. By “getting away with it,” he comes across as a protected elitist - especially if others around him are indited. In the long run, that may be more damaging to him/reputation. He will be the symbol of how laws are for little people.

That memo was classified as "confidential" — the lowest classification level — after Comey sent the information.

If this is true, then at best the case would have been weak, and a conviction would in no way be assured.

A confidential classification is pretty close to meaningless. I doubt anyone has ever been tried and convicted for releasing a confidential document. It would be a justification for disciplinary action or firing, which is exactly what happened to Comey.

The takedown of the conspirators like Comey is an unfolding process where public opinion is being shaped and Barr is informing the public and making his case.

This is the start of the roll out of prosecution.

Comey is first and the public is getting a taste of what Comey was up to and we are slowly coming to grips with the concept that an ex FBI Director engaged in a complex and wide ranging conspiracy to frame and overthrow a sitting President

The conspirators have been trying to style themselves as outspoken critics of Donald Trump so when the indictments come they can scream political payback and persecution as a defense.

Dribbling this out and shaping public opinion to where a large portion of the voters are angry and demanding prosecution is a smart strategy to counter the victimization defense the bad guys have been building for several years

Thanks for the link, certainly worth reading.

The Washington Examiner article is just a rehash of John Solomon's article, based on a leak, not an official DOJ press release.

Obviously, it is great news that the IG made a criminal referral. The Brian Cates link indicates that since Comey signed an NDA, there is no statute of limitations. So, AG Barr can change his mind and prosecute at any time.

So, at this point, its another waiting game.
