A Montana judge has blocked a Trump administration policy change that stopped nonprofit groups from identifying their big donors on federal disclosure forms.
U.S. District Judge Brian Morris ruled Tuesday that the IRS didn't give proper public notice before it stopped requiring social-welfare groups, labor unions and business associations to identify donors contributing more than $5,000.
Morris says the IRS changed the 40-year-old rule last year without an opportunity for public comment.
He suspended the rule change until the tax agency allows public comment.
Montana Gov. Steve Bullock and New Jersey Attorney General Gurbir Grewal sued over the change.

IMHO, if federal law mandates a specific time frame for public notice, then the department (in this case, the IRS) should follow the law. Seems simple to me.

If I read it right, there was a 40-year-old IRS rule that required social-welfare groups, labor unions and business associations to identify donors contributing more than $5,000.
It seems like that is a good thing. Why would the Trump administration want to end that sunshine?
So does this apply to cities which make simple acts like not signally a lane change in a vehicle with no traffic a big fine.
Also, the charge is not considered a serious moving violation and isn’t reported to the DMV.
The IRS did not claim they gave proper notice. IRS lawyers argued unsuccessfully the states can’t challenge federal tax policy.
But what if judge simply “thought it was a good idea” or that the IRS “didin’t give a good enough reason” or “Trump didn’t wash his hands after going pee-pee.”
Not passing judgement one way or the other, but here is a thought. Every regulation has a cost and Trump has been all about reducing regulation and cost to business. So I see a good side to this. If you are concerned about certain "charitable foundations" hiding donor lists and using the funds for political reasons, then I can understand your question. I think legally they may fall under a different set of rules, but cheaters always gonna find a way to cheat.

So, this situation is binary...the IRS did or didn't comply with the public notice requirement. If they did, then proving it is a simple matter of showing the date it was published in the federal register. If they didn't, then the judge made the correct ruling.
IMHO, even an obama judge would have a difficult time ruling against the IRS if they gave proper public notice.

Very poorly worded article. I think the regulation would require them to identify donors over 5k and the judge blocked it from taking effect.
