July 12, 2019 (LifeSiteNews) A mother in the U.K. is suing Englands National Health Service (NHS) for more than £200,000 ($249,000 U.S.) for wrongful birth, alleging that health care workers did not conduct tests that would have revealed her unborn sons Down syndrome.
Edyta Mordel told Londons High Court that had she known he would be born with Downs, she would have aborted her child, now four-year-old Aleksander, the Daily Mail reports.
Mordel, 33, says she requested the tests during her pregnancy and was devastated when her baby was diagnosed with Downs after birth.
The case is legally classified as a wrongful birth because Mordel says she would have had an abortion if she had known about the condition.
Mordel is seeking compensation for increased financial expenses of caring for her son and the impact it has upon her ability to work, the report said.
She learned she was pregnant in 2014 and said she told a midwife at her first appointment that she wanted the Downs screen to be performed. She thought the test had been done at her 12-week appointment and shed been cleared of the risk for Downs.
But the test was not performed, the NHS is arguing, and the sonographer had recorded Downs screening declined in her records.
Lawyers for the NHS claimed that Mordel was offered the screening but had declined it and bitterly regretted her decision after Aleksander was born, something she disputes.
I was always sure about the decision and I always wanted it, she stated. I spoke with the midwife about Downs syndrome screening. I had informed myself. I watched a lot of videos and read about screening.
Her attorney said the screening would have shown the high risk of Downs, which would have been confirmed by further testing.

Such a winning attitude, this one.
PING!
Selfish witch.
Put the little one up for adoption.
This was predicted, and it is here.
Funny. Rosie o’Donnell ‘s mom said the same thing
Mum of the Year. Not.
That kid’s going to have a fun childhood being raised by a mom that wishes he was dead.
She’s a Polish immigrant to the UK. Apparently, she refused the Down’s test due to a risk of miscarriage (2%), according to her records, and doesn’t remember saying no. This has been floating around for a bit now.
Truly sad. That poor boy.
Think how this must make the boy feel.
Awful. I hope she does not maltreat that child.
I don’t believe this.
Just someone taking things a little too far, to make a point.
Today while going about my business a saw a young lady with the condition out with her mom running errands.
This U.K. egg donor / incubator (seems poor to call her a mother in light of this) needs repentance badly. Instead she’ll probably get psychiatric treatment or self help leading to sheltering her, coddling the selfishness she is exhibiting.
Take the child away. Give him to a family where he will be loved and his life will be cherished.
Good grief. “Wrongful Birth”? Moot Court issues from a quarter century ago are coming to real life. Sickening.
We have one who works as a bagger at our local grocery store.
Pleasant enough guy, careful with our groceries. He chose to work. Props on him.
I agree. The kid needs a loving home.
She should move to Virginia. Northam will help her out.
More than just your local grocery. It is a nationwide effort among some major chains to hire people with certain afflictions like Down's Syndrome.
I'm sure that they also get some kind of tax incentive to do so, but that seems like a win/win situation for everyone.
Also noticed that the new MARKETING technique being pushed to brick and mortar stores is to mix up the product locations so that you are forced to go through every isle trying to find the exact product you are looking for.
