Harris and Gabbard Not Constitutionally Qualified To Be President or VP by Attorney Larry Klayman

Senator Kamala Devi Harris (D-California) cannot become president unless she is a “natural born Citizen.” The U.S. Constitution contains few eligibility criteria for our nation’s highest post. But being born to the country is one of them. Since a vice president must be able to succeed to the presidency, Harris could not run as vice president, either.

Article II, Section 1, Clause 5 requires that only a natural born citizen can serve as president. The Constitution clearly distinguishes between a citizen and a “natural born Citizen.” There is a special case of citizen who is also natural born. An interesting but often-ignored requirement is that one must also have “been fourteen Years a Resident within the United States.” The intent indicates an attempt to ensure allegiance to the United States by a strong connection. This was the result of continued loyalties to the British Crown among Tories and others after the Revolutionary War, where some politicians even suggesting the nation should return to a limited monarchy. The Framers thus wanted to eliminate “family influences” among our presidents.

Some may think of the Fourteenth Amendment. Even if we ignore the requirement that a person born in the country must be “under the jurisdiction thereof,” the Constitution clearly recognizes that not all citizens are eligible to be president.

Both of Harris’s parents were present in the United States under student visas when Harris was born in Oakland, California. They were not U.S. citizens at that time. A student visa requires a non-immigrant intent. That is, one must swear that they have no intent to stay. I think it’s a pretty safe bet that most, of not all, the ‘candidates’ use most of the leftover cash for personal gain.

They may record it as something legitimate, but...

And while the Constitution does not explicitly state that any candidate for president must be a sentient human being, Kamalback Harris and Convulsi Gabbard fail on both those counts as well.

When Herbert Hoover first ran for president, there was some question as to his eligibility. Because while he was for 14 years a resident of the US, it wasn’t in the 14 years right before the election (Hoover was out of the country doing relief work).

The courts did not take up the issue. They said, essentially, let the voters decide. And Hoover was elected.

I suppose the same thing will happen with this natural-born controversy.

If We the People don’t have standing, nobody would.

The charade everyone put on with obama was because everyone was afraid of being called racist or homophobe or maybe they feared death or personal ruin.

We are not about to allow that to happen again.

Correct. The Courts have never adopted klaymans view of born citizen.

My belief is that the parents of a candidate must be citizens. Note that the word “parents” is plural. In other words, both the mother and father must be citizens. In my case, my father was born in Texan and my mother was born in Vancouver, BC. So my birth in the United States to a Canadian citizen and an American citizen disqualifies me to be President of the United States. British common law at the time of United States independence required both parents to be citizens in order for their children to be Natural Born Citizens. Also, United States and English common law at the time our Constitution was framed were identical.

Thanks. I suppose you’re right. We won’t know, though, unless someone tries to take it to court. It’s telling that the other candidates haven’t objected to Harris’ or Gabbard’s citizenships.

After Barak Hussein Obama the provision for Natural Born Citizen is moot. Resident 0f The USA is probably the only requieremet now.

The 14th amendment is very clear. There is a certain line there that I really really don't like. But until it goes away people born in this country are citizens by birth. The arguments being raised by the various birthers are specious and have been laughed out of court repeatedly. It is very hard to beat these people if we don't have at least one foot planted in the real world and this kind of fertilizer just makes us look like a bunch of nuts, which plays into our enemies preferred narrative.

Exactly. For all intents and purposes, you are either a natural born citizen or a naturalized citizen. If you’re an American citizen and you’ve never been through the naturalization process, then you are a natural born citizen.

The left only cares if they can see trumps tax returns. On a side note: The states who are adding to the eligibility requirements to be president.- clearly they must be slapped down hard. Even congress had no authority to do that. Congress should however ensure that the requirements set forth in the constitution are upheld. Such as the requirement to be a natural born citizen.

The birthright you refer to is from Feudal times when the Kings owned and had jurisdiction over everything in the kingdom, including serfs passing thru and having babies (very infrequently). Most of the world’s nations eschew this jurisdiction to favor citizenship determined by parents. These countries include India and Jamaica, Sen. Harris’ parents’ countries of origin.

Harris is ineligible but that will not stand in her way. Obama had a non citizen father and was born a Citizen of the British Empire thereby. If “natural born citizen” does not exclude that then it excludes no one. Rubio, Cruz, and McCain were all proclaimed by the Congress to be NBCs in order to “naturalize” Hussein and that was eagerly accepted by the political class entire and by most of the population.
