Immigrant advocates sued Thursday to preemptively block President Trump’s threatened new round-up of thousands of undocumented families this weekend.
The White House insists the raids — the same ones that Trump scrapped last month — will target immigrant families that have already been given deportation orders.
But the ACLU says many of them have never had a day in court due to massive bureaucratic bungling.
“The Trump administration’s threats against immigrants run roughshod over basic fairness and due process,” said Donna Lieberman, executive director of the New York Civil Liberties Union. “We will fight to ensure no one faces this kind of peril without having their case considered in court.”
The suit was filed in Manhattan federal court on behalf of refugees from Central Americans, many of whom say they have tried without success to get hearings.
It demands that anyone detained in the planned raids be granted a hearing with a judge before being deported.

Trump has deferred to courts on immigration form terrorist nations and his emergency declaration which was not overridden by congress. Yo9u can’t run a country if 200 judges can tell you how to handle emergencies.

This isnt the 1820s where it would take weeks to get word anywhere.
The ACLU and Co. aren’t just sitting around clueless either. They have this stuff filed and ready to go at a moments notice too.Some of you have this weird idea that ICE can round out 1,000,000 people, scurry them to planes, and have them up in the air and back in (insert nation here) before these dedicated activists have even gotten word. Maybe the right is that pathetically slow, but the left isnt.

Now just a cotton pickin’ minit here. Let’s be fair. The court sent a notice to the asylum seekers’ stated address, which was bogus. Therefore, they didn’t get adequate notice of a hearing date, because the court clerk failed to find out their real addresses.

It’s the “this court” part of your senario which I have trouble with. I don’t believe that the ACLU has any intention of challenging the orders in the same federal court that issued them, but in some other convieniently chosen district court, which raises a jurisdictional rather than standing issue.

The minute the raid start, people WILL know, and the usual will demand emergency hearings from a shopped judge.
That isnt going to take weeks, but hours.
So no there is no “surprise”. These people will not be on planes, properly ID’d and out of the nation by then.
