WASHINGTON (AP) President Donald Trump is expected to announce new executive action Thursday during a news conference on the 2020 census and his push to include a citizenship question. Trump tweeted Thursday morning that he planned a News Conference on the Census and Citizenship after a White House Social Media Summit. A senior administration official, who spoke on condition of anonymity to preview the plans, said the president would be announcing new action, but the official did not elaborate. Trump said last week that he was very seriously considering executive action to try to force the questions inclusion, and that it was among four or five options hed been weighing.

An interesting ploy. In the lawsuit, the issue became whether the department was being forthcoming in their reasons for requesting it.
Now, the President will have his own reasons for doing so, by executive order, and surely as President he is in charge of the commerce department, and can have them put the question in.
And it SHOULD require a NEW lawsuit to be filed, one that claims the President does not have the authority under the law to have his department do this.
Section 2 of the 14th Amendment requires that the government know the number of male citizens. Justification enough for the question as well as male / female question.
The court said adding the ? was constitutional.
It should just be put in as planned and Trump can email Roberts an explanation.

Interesting that you used the word “required.” Do you think a lawsuit SHOULD be filed? I’m sure one (or more) will, but I’m wondering if you think the action would be an appropriate use of Presidential power.
Let the courts enforce their edicts. They have no enforcement power whatsoever. The Executive and Judicial branches are co equal. It’s time for the Judiciary to understand that. Just announce the question will be on the census forms and move on.

How did Obama get the question removed?
If he announces this plan Thursday afternoon the challenges will be filed in court by Friday morning.
I would think that by citing the 14th amendment as the authority, this would prevent lower courts from blocking it, as they are creations of Congress and inferior to the Constitution.
Only the Supreme Court should have jurisdiction when the Constitution is cited directly by the President.

What is confusing to me is WHY SCOTUS didn’t say - Your justification is crap, should have used this one, but approved anyway.
