Nevada bans employers from refusing to hire those who fail marijuana tests

I presume that that includes law enforcement agencies also.

Who knows, but it is coming.

Airline pilots, physicians, surgeons, and all professions and disciplines will be included.

In the future one cannot discount being flown in airliners who crew are high from recently smoking marijuana. Having their surgical procedure paused while the surgical team goes burns one. Or standing before a judge that hes just smoked a joint. Or being pulled over by a police officer that has just finished burning a joint. Plus the oodles of impaired drivers on the highway[s]

Just because he failed a test, does not mean he’s high at work. The problem is that it stays in the system for close to a month. The other problem is there’s no way to differentiate If someone used it on a Saturday / weekend on their free time -( the same way that a person would consume alcohol) vs being under the influence on the job the following Monday (or any work day for that matter).

They need a test that will show if someone is currently under the influence.

Alcohol is a legal drug.

Pot, depending on the jurisdiction, is not.

Suppose he outperformed all your other employees,
and you just now found out he did coke at home,
would you fire him?

Coke and weed are completely different. I’d personally prefer hanging out with pot smokers than alcohol drinkers. I personally do neither. After chemo, alcohol makes me feel awful. I don’t like the way THC makes me feel either although I tried using it LEGALLY over the past year for medicinal purposes. If it took my Neurapathy pain away, I’d figure out a way to tolerate the effects. But, it did not take my pain away Some people like the way they feel with it, just like some people like alcohol. If one had to be banned - alcohol or THC - it should be alcohol.

It is probable that pot will be at a minimum decriminalized across the entire country. I would guess it will be legal and taxed in 30 or so states within the next six to eight years.

Not to am employer, they’re not.

Users and/or abusers of recreational drugs have higher medical costs, insurance costs, turnover and absence rates.

They are just not worth hiring if you can help it.

There’s a legal standard for alcohol intoxication that’s recognized nationwide.

Tell me, what’s the standard for THC....

In those places where weed is legal, it still is not ok to show up at work under the influence - just as with alcohol. They need a test that can determine if someone is currently under the influence. At this time, they can only determine thru urine/hair/blood where it is in the system for a month.

Won’t happen.

The “added risk” is negligible at worst.

Because workers can still be fired for being high on the job. Or for substandard performance. Or because their job has been “eliminated”.

And alcohol doesn’t cause issues at work? How many people show up with or don’t because of hangovers? That’s just one issue. Changing the criminality status is only one part. They still should not come to work under the influence. How will someone determine who is under the influence after its decriminalize or where it is already decriminalized?

Marijuana prohibition is idiotic and hypocritical. Drug dealers don’t ask for id. That’s why it’s available to kids. Why should adults be prevented from smoke pot? Adults can gamble, drink, smoke and use tobacco. Why not marijuana?

My job hired a company that tested us randomly. They had a breathalyzer machine and collected urine. If they are already testing, then they should get up to speed with the issue.

And you might say that some users are good employees, but the fact is, I shouldn’t be forced to take that risk.
