TRUMP ADMINISTRATION WILL ASK SUPREME COURT TO END NATIONWIDE INJUNCTIONS, PENCE SAYS

Vice President Mike Pence announced that the administration will look for opportunities to challenge nationwide injunctions before the Supreme Court.

Such orders have obstructed the Trump administration’s agenda in a number of areas.

Though such injunctions have angered Trump loyalists, conservative litigators employed them against former President Barack Obama.

The Trump administration is searching for an appropriate case in which to ask the Supreme Court to end nationwide injunctions, Vice President Mike Pence announced Wednesday in Washington at a Federalist Society conference.

Nationwide injunctions, in which federal trial judges bar the federal government from enforcing a law or carrying out a policy across the entire country, have beset President Donald Trump since he took office. District courts have blocked administration policy priorities on immigration, national security and health care.

“The Supreme Court of the United States must clarify that district judges can decide no more than the cases before them — and it’s imperative that we restore the historic tradition that district judges do not set policy for the whole nation,” Pence told the conservative lawyers group.

“In the days ahead, our administration will seek opportunities to put this question before the Supreme Court — to ensure that decisions affecting every American are made either by those elected to represent the American people or by the highest court in the land,” Pence added.

No no no. He should have simply ignored the ruling and not even bothered taking it to court. No sane person would think our law allows some activist judge to decide who can come in to this nation. Imagine what these kook judges could have done with this nonsense at the height of the cold war.

The US is a republic. Representatives are elected by citizens and then those representatives legislate according to their own best judgment. The citizens can - if they wish - exercise various mechanisms for removal from office.

Tthe republic was expressly designed to avoid direct democracy.

When the left can’t legislate, they judiciate the laws. This was and is a common tactic by the envirowackos that has spilled over. When will the repubes learn to fight fire with fire? When the demonrats get a taste of their own medicine, they seem all too willing to change it.

Why are you assuming SCOTUS will rule that way?

Why would you expect a black robed king to volunteer to give up power?

We as Christians need to stop assuming people will follow rules in a post Christendom situation. They will rule against Trump for no other reason as to not limit their self interest.

Assume people will do the greedy and evil thing.

This is Trump's YUGEST mistake as it set precedent for a low-ranking judiciary to overrule an entire branch of government. While he was naive on this point it is the job of his staff to help, not stabbing the entire nation in the back.

How could Trump address this when SCOTUS would have ruled against him? Now with Kavanaugh and Gorusch, SCOTUS is much more reliable.

Judges have to follow the law also and the low level judge that stopped the travel ban was so outside the authority of the court his ruling could have and absolutely should have been completely ignored. Had the white house done this it would have changed the entire trajectory of Trumps first two years. At this point it’s water under the bridge but this still must be stopped.

It’s really simple. Without a majority of reliable SCOTUS justices, it would have been too risky to bump it up to SCOTUS. Now he can.

So true. The Trump administration made quite a few mistakes out of the gate that have haunted his administration.

First, no purge of Obama hold overs, secondly the cracker from Alabama sold him out and thirdly and mostly, he did NOT prosecute HRC as promised.

You are correct and it is the responsibility of the Citizen to see that their elected officials fit the bill.

But alas, all politicians are liars and thieves that hoodwink the Citizen into believing they are the second coming. That is why the Constitution allows the Citizen to disband the government if it sees fit.

It can be argued that a decision was made not to carry the decision to SCOTUS because it would not be taken up or would lose. The VP seems to be signaling that they now have a case to carry forward.

o one is getting what I said. The first lower court ruling on the travel ban should have been ignored, not challenged to scotus. Just make a statement the court has no authority in this area and enforce the ban fully.

My take on ignoring the first injunction is that act of ignoring the injunction would be the vehicle used by the left carrying the case to the Supreme Court.

It seems an Administration decision was made not to contest that specific case for reasons unfathomable to me. They chose not to fight that specific battle
