I would pull my child OUT and put her in PRIVATE school.....CATHOLIC!
The only purpose of this kind of law is to prevent peasants from gathering evidence against government representatives.
If I were satisfied with the evidence, would have gone to “talk” to the culprit myself.
I’m pretty sure, if it was my kid, whomever was doing the abusing would be replacing car and home windows every month for the next year.
That is, if the law isn’t there to protect my kids, then I’d use Street Law. North Philly style.

Easiest way to get the recording into court is to use it in my defense after having beat the crap out of the perp.

The Mother did the right thing. The recording should most certainly be allowed into evidence.

It’s a one party consent state and a classroom is not a private place so how would this ever go anywhere?

The audio “may be disturbing to some”. Working with a special needs child in not easy.
Berkeley County Prosecuting Attorney Catie Wilkes Delligatti along with investigators reviewed the eight hour audio recording, and said while they can’t prove that any abuse or neglect occurred that created a risk of death or bodily injury, she is “not in any way condoning the verbal treatment of your children by the individuals in their classroom.” She adds, West Virginia law states that verbal abuse of children is not a criminal act.
Most of what I hear was just talking to child to engage the child. but take the time to listen before deciding.

Install GoPro body cams for your public school child. With real time internet, the parent could have an immediate cell call to the school.
So “Public Schools” are not public places. And Public school teachers are not public servants.
